If somebody can enlighten us on this question. My I 485 is still waiting for approval and my husband was already applied for to follow upon approval of my green card. We have been waiting for almost 5 yrs now. I've been using a parole to get in and out of the country.

My question is can my husband apply for a tourist visa while waiting for the result of our green card?

He can apply for a Tourist Visa at ANYTIME and since he's not a LPR of the USA as yet he would need a visa to visit.

Question for you.. Are you a US Citizen? Why do you need to be paroled to get in/out (his) country...? Please clarify.

He can apply, but the major stumbling block will be this: what is he going to say that will convince the VO he would depart the US instead of staying put to go thru an AOS?
