After reading all the posts, I am still confused about K3 vs. CR1. In my case, I got married 3 weeks ago and was planning to file for K3 visa for my wife. I am a U.S. citizen. This is my second marriage. My first marriage was via the K1 pathway, which ended in divorce (after one year of marriage). Marriage ended before she would have gotten the permanent green card. Given my circumstances, is CR1 still a better option for us than K3? Will CR1 allow my wife to arrive in U.S. more quickly than K3?

The K3 is administratively closed, so CR-1 is the only available visa in your case.

The path to a K3 visa will be closed by the National Visa Center, should one start down that path. K3 is a visa that will never be issued. What is administratively closed is the I-129F petition for spouse, once it arrives together with the I-130 at NVC. Skip filing the I-129F. It will simply delay the approval of the I-130 that starts the path to the visa that's actually still available.

False and misleading statements are NOT be best way to convey needed information, though they are sometimes easier to type.

I was wondering the same thing when i filed over 6 months ago. I filed for K3 and recently got both i-129f and i-130 approved and headed to NVC.

at NVC, they will close the i-129F and continue with i-130.

So it is CR1 !!!!!!!!!!!!!! :thumbs:

K3 no longer !!!!!! maybe on VERY VERY VERY RARE circumstances which i haven't even seen here on VJ !

When we petitioned, back when the K3 was an option, it took 8 weeks longer to get a through USCUS than those of us going for a CR-1

Thanks for all the information. That was really very helpful. After my wife receives the CR1 visa, how much time will she have to travel to USA? In other words, how long is the CR1 visa valid for after it is issuesd.

Usually 6 months. Once the visa is received, there's an expiration date printed on it, so you could verify.

Both, when filed solo it acts for a petition for a fiance. Filed with the NOA of an I130, it acts as a petition for a spousal visa
