Timeline

Just a quick question. My fiance (the USC) has 2 children by a previous marriage. They do not live with him and are not listed as dependants on his tax return. He is on social security so we will need a joint sponsor but will our household size be for 2 (me and him) our will have have to include his children also?

When we have a joint sponsor does it have to be 125% of the poverty level for their household and ours or just their household as they are not expected to support our household? (just me)

OUR STORY

February 2009 - Met online online on social networking site

August 2009 - Spent 2 weeks together in England in which time we got engaged !!!!!YEY!!!!!

October 2009 - Spent 2 weeks together in America

December 2009 - Spent 5 months together in England

May 2010 - We both went to America when we spent 2 weeks together

August 2010 - Spent 3 weeks together in America

December 2010 - Spent 5 months together in England

May 2011 - We both went to America together where we spent 2 weeks together

September 2011 - Spent 3 weeks together in America

December 2011 - Spent 5 months together again in England as with the previous years!

April 2012 - spent 2 weeks together in America, got married on May 8th in America!!!!!!!

Joint sponsor only has to cover 125% for their own house + the intending immigrant.

The petitioner's household count will include his minor children. It doesn't matter if he does not claim them as dependents on his tax returns. The instructions for the I-864 Affidavit of Support which your petitioner must turn in to adjust your status requires him to count his minor children in his household.

For the Joint Sponsor's household count, it would only include the JS, his/her spouse, minor children, anyone the JS has a current I-864 obligation with, his dependents, and the intending immigrant. The petitioner and his US citizen children are not counted in the JS's household count.

Need more information. Are his kids grown and gone? Is his social security the retirement kind? Disability kind?
