out of status...AOS help!

hello everybody..here i am again asking your help or comments..i entered here in US thru K-1 visa last june 2011 and got married last Aug.so i got married before the 90 days..and my visa was expired last Oct..And what keeps on bugging me is that my status ccoz we didnt file yet my AOS till now due to financial problems.So since my visa had a stamped sept.15 so that means that thats my 90 days since i entered here in US.and my visa expired last oct.so now since on my 90 days here(sept.2011) its been almost 6 months that had passed..so im really out of status.And what makes it worse is that my husband said he dont know if when we gonna file that AOS..makes me really sad and worry:(...

It would be ok if im really late to file my AOS..?or it would be ok if i will file my status later since i am really out of status..will the immigration will deport me?coz some of my friends told me that the immigration can deport me..Is anybody here have same situation as mine?What did you do? will need your help and comments...I screwed up my life... thank u in advance

theres no time limitation on when u file for Aos as long as you get married within the 90 days you will be fine.

There is no deadline to file for AOS but yes you are out of status and yes if you run into immigration (they are unlikely to come looking for you unless you break the law) and they check your status you will be locked in immigration detention until you go before a judge who will order that you apply for AOS asap. It is important to file as soon as possible to protect your status, be able to work, drive, go home etc but if you need to wait a bit you can

and one more thing to ask guys..since my medical result will be expire this coming April is it ok to go a surgeon before my medical will expire?? and it would that be ok if i will use that if the time will come that im gonna file my AOS?

You're going to have to start your medical over if it gets more than a year old. If it was first time vaccines, you're most likely going to need some follow up boosters to the vaccines already. Keep all the vaccine records! You'll need those records if your exam is going to expire or not. If you can, get your AOS in before your exam expires. If you're going to let it expire, it will be a waste of money paying a civil surgeon to validate something you cannot use.

We mailed our package in today. They arrived on Aug 7, 2011 and we married Aug 15. 6 months. Just try to scrape the money together; $1070? Borrow it if you need to!! Good Luck!!

I agree with the poster before me; try to borrow the money. In the long run, it might pay off if you're thinking about working too, at least to help pay off the loan.

You question has already been answered. You won't be denied because you're filing late but if 2 years pass after getting married(I of course don't suggest to wait that long), file i-130 and i-485. That way you'll end up with a 10 year greencard and won't have to remove the conditions.

Need Help!

Would there be a need for a lawyer if applying for AOS because of marriage to US citizen and I-94 is about to expire in a few days?

Application for I-130 and I-485 will be sent out, what if USCIS received it after the expiration of I-94 but it was mailed before the expiry date?

Does it need a separate set of documents for each I-130 application for children of spouse being petitioned?

Would appreciate your help.
