The key in the question (I believe) was word "legally" - it wasn't necessarily legal (father did not have legal status for sure) and while the son/stepson wasn't legal he does not accumulate illegal presence until 18 years old.

No this is what the step mother wrote " My stepson came legally to the US when he was only 6 years old" this states that when he entered the US at 6 years old he was legally here.

A work visa can last for years. She didn't stated when their status actually became illegal, she only states that their status as of her writting they are ilegal.

Yep. "Came legally" just means they entered with inspection - a visa or other entry pass. They didn't walk across the border. Makes a big difference in AOS cases. :thumbs:
