Hi VJ members...

I have couple questions! Help please!

#1) I'm wondering when should I file my I-751 I know that in the PDF(I-751 instructions) file says "you must file 90 days before the second anniversary of the date you were accorded conditional resident status". I'm a resident since 2/28/2011 and the card expires on 2/28/2013. Should I submit my documents on November 28th,2012? Will USCIS reject my application if I submit my documentation on beginnings of November 2012 or earlier?

#2)Do you have to attend to an interview when removing the conditions?

#3) what the chances of getting the conditions removed if I get divorce and file with a request that the joint filling requirement be waived?

#4)I'm borderline to get divorce and not sure if it can be fixed. Should I try to talk to my wife to help me out until I get the conditions removed and then get divorce or is it better just to get divorced and apply on my own?

1, Yes you can not file earlier 90 days prior to your conditional resident expires.

2. Depends on how much evidences you submitted, how convincing they are, and the most important, how lucky you are. There are random picks for quality control, and some of them are needed for clear the "possibly fraud".

3. You can file it as divorced, but you would need to include if not bit stronger evidence, usually it goes through without much difficulty. However USCIS does pays more attention to divorced ROC applications.

4. Then for the sake of both of you, go ahead and divorce. However keep in mind that when USCIS asks you why you divorce, you should have good reasons, supporting evidences. As long as it can prove the marriage you had was for real and good reasons.

And the most important? Relax. You have more than a year to get your stuff right.
