I find it very suspicious that an ER Doctor would encourage this type of behaviour. He would know that ppl don't go walking into nurseries taking 2 days old out for fresh air. What were they thinking fresh air in Feb. at 2 days old and barely dressed.

It was Jan. 7th, the time was around 7pm the high temp that day was 59 degrees.

If you look at the video linked in OP you can see baby is bundled up.

Babies leave the hospital at two days on a regular basis.

some don't even stay 24 hours.

I even heard a rumour that a baby can be born outside of a hospital

I guess everyone knows now though that some of you guys posting here have a pretty shamefully low threshold for justifying violent behavior against women.

Where does anyone justify violence against women?!! Or are you one of those ****** that do not believe a woman can be guilty of assault against a man regardless of what she does, and that a man who reacts to an assault or defends himself then becomes the one guilty of the assault? I, for one, have very strong views about and am strongly opposed to violence against women, children, the elderly, the handicapped, etc. But don't try to tell me that if someone inappropriately lays a hand on me or my children I don't have the right to respond! The way the incident is described does make it sound like Kennedy's actions were excessive. But unless you were there I don't think you will know who is exaggerating what!

no one put a hand on him. the first nurse he grabbed had her hand on a doorknob. is it too much to ask that people actually read the articles and posts before commenting?

And you can say with a straight face that you would have no problem with a MAN actively preventing a WOMAN from leaving a place with no legal justification? And she has no right to attempt to counter what amounts to false imprisonment?

there was never any false imprisonment. ever. at any time. at this point you're just grasping at straws. if the hospital thought they could in any way lay blame on these nurses, or fault their actions and make them culpable for anything that happened here, they would have done so. they haven't. the state nursing board hasn't. they're still employed there, they're still licensed in NY. the only legal issues against them have sprang full blown from assorted posters' imaginations.

You really think the hospital would make any trouble it "could in any way" for these nurses? Or that the state nursing board would immediately revoke their licenses? And I have to break this to you, many crimes are never prosecuted. There is such a thing as prosecutorial discretion where the prosecutor does not have to attempt prosecution on every case! While what these nurses did was probably wrong, they may have acted without malice and only been unaware of what their rights and the father's rights were in these circumstances.

And most human conflicts do not require judicial assignment of fault and determination of punishment!

since the hospital is responsible for the nurses' actions they will do everything they can to avoid blaming the nurses.

Yes I am aware that babies leave the hospital as early as 24hr, they are usually discharged and no longer under the care of the hospital. This Doctor knew that it is not normal to have a father walk in and then try to take a baby for a walk outside. You can see that by the way he stood back to watch.

And yes ppl have babies at home all the time, but that is not what we are talking about.

The nurses did their job.

“As my hand touched the shoulders of the baby, Douglas Kennedy, raised his right foot, and with tremendous force, kicked me in the left side of my pelvic area,” Luciano said, according to the documents.

Kennedy was holding the baby just fine, she was trying to take the baby from him, He was defending his baby.

No one tried to grab the baby from him. Read the OP again, read your own article again. When this jackass twisted the first nurse's hand violently, while her hands were on a doorknob. While he was violently twisting a woman's arm, the child's head and neck were wobbling, video and witness testimony have corroborated this. The 2nd nurse stated that she was not grabbing at the baby but was reaching to steady the baby's head and neck, since his idiot father was currently violently twisting a woman's arm who had never laid a hand on him.

I think one of the problems you have understanding the logic of those that disagree with your point of view here is that you seem unable to subtract the subjective colorations of what otherwise might be considered objective observations of the incident by the witnesses cited. You seem to double down on this subjectivity! Using very pejorative terms such as 'jackass', 'idiot', and adding/repeating terms such as 'violently', adds heat but not light to the discussion. Facts do not need coloration. If this does work its way through the legal system, in the end it will be the facts without subjective editorializing by the involved parties that will become the basis for a legal determination.
