CCP Issue - K-1 Interview

Hello everyone,

I am new here. I am preparing for the K-1 Visa interview in Guangzhou, China in the coming March. I am really worried that my Chinese Communist membership will affect me to get the visa or may require additional background checking.

My tutor awarded me with CCP membership when i was in colleage (2007) due to good performace at school. Since graduation in 2009 , I have been Only working in an American-owned company. I don't hold any position in the Party and never join any Party meetings and whatsoever. Does anyone have experince in this or know some similar situations?

Since you are a CCP member, AP for a Security Advisory Opinion (SAO) is automatic. You will need to prepare a statement as to how you acquired your membership and to what extent your involvement (or lack of) with the party is.

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

oh thank you so much for your prompt response. As you can tell that i almost have none involvement with CCP. Besides, i have stopped paying dues for 2 years. If i state all the reasons say the reason to join and the involvement status, and just assume everyth else goes well, is the chance high to get the visa that day depiste the CCP status? i surfed online and it said usually the odd for a CCP to get the visa at the 1st interview is pretty low.oh .. i feel kinda scared for the additional processsing would occure to me.

The SAO cannot be initiated until the interview takes place which means your visa application being approved on the day of the interview is nil. Common sense dictates the SAO would come back favorably based on what you have posted (stopped paying dues, no involvement with the party). Write up you statement prior to the interview so you will have it ready for submission when the time comes.

oh and I have another question regarding GN1-2 FORM, Under item 17, Part C, it indicates as" Aliens who are or at anytimes have been anarchist, or members of or affiliated with any totalian party......1)Opposition to organized government. 2)the overthrow of government by force and violence. 3) the assaulting or killing of government officials. 4) the unlawful of destruction of property. 5)establishment of a totalitarian dictatorship in the united states........DO ANY OF THESE CLASSES APPLY TO YOU? YES_____ No_____

I don't know what i should put in this blank. i checked with US embassy here in China, they said they consider Communist party as a totalitarian party, but i am just a standard member and have never conducted the listed behaviors. what should I choose for this item ? yes or no? can i leave this item blank? any suggestions?

Hi lynnlin, welcome to VJ.

The US considers the CCP a totalitarian party and as you have stated you were a member. Even members with little or no participation are still members so I think you have to answer yes. As Ryan says have your statement written and ready before you go for your interview and you should be fine.

There is a sentence on GN1-2 form that really freaks me out. It's said " EXCEPT AS OTHER WISE PROVIDED BY LAW. ALIENS OF THE FOLLOWING CLASSES ARE INELIGIBLE TO RECEIVE A VISA." I was just thinking that I was doomed if i put a "yes" under this item. But yeah I agree with you, i will get the statement and my resume ready before the interview. Do my best and let hem decide.

Hi Lynnlin,

I just wanted to let you know that CCP membership is not always an immediate AP at GZ. The woman that was in front of my wife at the interview yesterday was CCP and she indicated that on all of her forms. The questioning at the interview was more intense than normal (45 minutes) but, they did approve her and it was her first attempt. I'm not sure how often this happens but at least there appears to be some hope.

Was that woman told she would be issued a visa soon or was she told the visa was approved pending the SAO?

She was told that she was approved and given the white paper. She was told her visa would be mailed out in 2-3 days.

Thanks for this valuable information. And congrats on the approval of your visa! I feel so happy for you guys. The long struggling process time was finally over.

Think now i have a better idea abt the interview and what i need to prepare for that.

I wish i can hear more stories abt interview at GZ.
