hello everyone! Just need a little assistance here! :help:

I will be submitting a I-130 with the intention of K3. I had gone to immigration yesterday just to have my packet looked over and make sure everything that was needed was included. I was told by the immigration officer that I did not need to include any phone records, pics, emails etc at this time . I do have a letter from my bank listing my husband as beneficary to my account so I am not sure if that is why he told me I didnt need any sworn affidavid. I just want to make sure that everything is included . Any assist you can give will be greatly appreciated.

Why the extra effort petitioning for a K-3? It is for the most part a dead visa option.

Immigration officers will know the minimum requirements to file a petition. They have little if any insight to specific embassy/consulate matters. Lagos is the hell pit of all places to pass through. If you read the resent Nigerian postings you will see a flurry of denials. This is common from Nigiera even from those that are the most prepared and certain that they will get a visa. It is a place where I have seen a couple that were village mates and have a child get denied as not bonafide. ( Based on the wife saying her husband wanted the daughter educated in the US ) They have a habit of denial for nothing. The supposed first rule of making a denial is that they have discovered a fact not known to USCIS/NVC when the petition was approved. Front loading ( putting lot of stuff in the petition ) makes this harder in theory. It sometimes backfire by giving them more material to develop questions from ( someone once got denied for not correctly answering questions about they layout of the USC's home ) So front load away but make sure your SO is aware of everything in the package.

K3's have been being approved again. Filing the second petition if it sneaks through gives you 2 attempts at a visa for one fee. It is needed many times in Nigeria.

This will not be over quickly. You will not enjoy this.

Don't even consider filing for the K-3, if you look at the comparason guides or even read around, the k-3 takes long and his more expensive

Now, since you'll be dealing with one of the most difficult consulates, I suggest you include as much as possible. Phone records, affidavits, pictures, etc. Then bring even more evidence to the interview. You'll want to focus heavily on primary evidence, passport stamps, bording passes, things that show the amount of time you've spent together.

Listen to Nigeriaorbust. The immigration person you spoke to is just speaking from the minumim requirement. You have to realize as was stated this is Nigeria, Fraud Visa capital of the world #1 I'm afraid. So the norm doesn't apply. You need to frontload your petition.

I have 275 pages of evidence i am presenting. What you and your Nigerian (I would assume man) ned to think about is do your have any Red Flags. Like for me its I am 21 years older than my husband. So we have to been prepared with evidence or something to show this is not an issue for us. Affidavit from his mum (we are the same age), aunt, and uncle and best friend.

Maybe its married more than once, children, religion. Whatever you think that may make them take pause load up evidence to prove its no wahala.

And phone records indeed plkease present. That IM's, Emails (just the logs save actially emails and stuff for interview). Thats when you come with everything and the kitchen sink. Pictures to family, friends, wedding, engagement, honeymoon, vacation, Whatever.

You see your petition is going from the USCIS hands (i am sure many touches. just imagine all those eyes on your stuff), from there to NVC another look, touch, than off to Embassy to get ready for interview, Theres no way they haven't already formed a decision Approved or denied. So you want to present the best you have and then some. Tell your love story like no other. Because unfortunately we are guilty of scam marriages or fraud and we are trying to prove ourselves innocent of all sterotypes and assumptions.

Don't be discouraged in all said and read here and other pages. There are happy endings. Just sometimes longer than anticipated jpourneys. Just be prepared get your things together. Think like a CO not a person in love and you all will be okay.

Phone records and pictures is what the CO was interested in for us. Didn't really look at our emails and IM. However, I would be prepared for anything. It doesn't hurt to gather as much evidence as you can to prove your case.

ya, remember - an Immigration Official IN THE USA mostly, not know the adjudication process for a VISA at the IV Unit in Lagos, Nigeria.

Please point me to some evidence of this. I saw some indication in the early autumn but it all dried up. Have you seen an I-129F petition for a spouse get through NVC recently? If not, my advice is to NOT follow the I-130 with an I-129F.

I agree with front-loading petitions that will end up in Lagos and many other high fraud Consular units but keep in reasonable. If you send them say 275 pages, you can't expect the Consular officer to actually review ANY of those pages. If you send them 20 pages of good examples, they might skim some of it. Sending a reasonable amount lets you have some control over them seeing quality, targeted evidence. Sending too, much pretty well assures they'll see none of it. Don't kid yourself into thinking Consular officers take time to read novels or even novelettes, prior to an interview.

Facts are cheap...knowing how to use them is precious...

Yes I have seen it. We have a couple locally that is going through AOS after wife/child arriving on K3/K4 and I know of one in process and scheduled for a K3 interview.

This will not be over quickly. You will not enjoy this.

I'm very interested in the details, such as when were the petitions approved. What special circumstances do you think cause the I-129F to arrive separately from the I-130 at NVC? I know some K3 visas have slipped through but I've seen no indication since a brief time in the fall that there may be any reason to think anything has changed at USCIS or NVC. If the vast majority and I mean more than 90% or even more than 99% of I-129F petitions for spouse end up dead, then filing one is still a bad idea. I would love to be convinced otherwise, as the K3 is a perfect visa for some in special circumstances. If they just want to save time though, the K3 process stopped saving more than 4 or 5 weeks AT BEST back in late 2006.

I think Pushbrk is right here. If one K-3 slips through, it's really one in a million. The K-3 has been dead on arrival for years now, and filing the I-129f after filing the I-130 is more likely to add on extra time if anything.

Even if your I-129f was approved before the I-130, it would be a matter of weeks, a month tops. The beneficiary would then arrive as a K-3, and you'd spend a bunch of extra time, money and waiting having to adjust status after arrival.

The K-3 was designed for the time when I-130s took years to process. Those days are over.

Getting an I-129F through NVC through some convoluted course of events is not an indicator anything has changed. Sounds to me like two flukes, nobody knows enough about to even WANT to try to reproduce in a case filed now.
