Hi,

We are now preparing for the package 4(CR1), interview and stuff.. But since my american husband and me(Thai citizen) met and lived abroad for a couple year. Our income generated abroad cannot meet 54,000-55,000 USD something averagely for the affidavit of support, I-864 form. So my husband has to go back and find a jobs. So now my husband is hired for about 3,000 USD /month before tax. And I am now waiting for him at my home country ( Thailand), kind of painful but it's the way it is... :(

Anyway, so now I wanna ask if anyone know that how long we have to wait to schedule for the package ? Under our conditions as follow:

1. My husband job starts at Beginning of March 2012 , 3,000 USD/month before tax. And will pay tax for this Apr 2012.

2. We have our good friend to be a joint sponsor. She is self-employed this year. And she also has a steady paying tax for the last 3 years.

3. I have my own saving in Thai Baht for about 20,000 USD ( some of money is still in my mom's Thai bank account because she take it to do funding and get a profit for me) and my husband's saving in USD for 10,000 USD( american bank account).

So my question is, owning to the financial support above, how long ( the shortest time) to wait to process the interview( for the successfully get approved)?

Another question is that... for my saving in Thai baht currency now. Some of money is in my mom's bank account. If I get her to transfer money to me in the big amount, is it count as the financial support in I-864 ? Will they suspect that I am buying a green card even though we are married for almost 2 years and live together in South Korea?

It is one of the most painful time...

Would appreciate any advice for the questions above T_T

I am not sure what you mean by " schedual for the package". If you are asking when the petition could be filed, that can be done now.

Keep in mind that the petition submitted to USCIS will take about 6 months to be approved. The 864 is submitted to NVC after that approval meaning he will be employed for sufficent time to qualify without a cosponsor. Study the support requirements a little closer & you will learn that you will not have problems with the support aspect.

Exacty when you will be granted a visa is not easy to say but it will happen. See the timelines here on V J for a good indication of how long. The 130 petition will take about 6 months. Then about 2 months at NVC depending on your husbands responce time to send in the required forms & fees. Interview date in BKK will be about 2 to 3 months after NVC approval.

Because of the length of your marriage ect there is almost zero chance that you would be denied a visa. Just follow the procedures & you will succeed.

The most difficult part of this journey is the separation & waiting. Use everything you know to overcome this. Invest your time in your future by learning about America for example. The U S govenment, taxes & English. These things have helped me to enjoy & undersatnd better the new country I call home.

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

ok, the whole story is that...

We married in Thailand 2 years ago. I am Thai citizen and my husband is USC. He is English teacher living abroad for 6 years. And after we married, we moved to South Korea to teach english and planned to go back and settle in USA. While we were living in Korea, we filed for the CR1- July 8,2011 ( since we r the residents there so we can file a spouse visa there).

Until we reached the package 3, we understand that,for I-846 form, if our income is generated outside US we need to have 3 times of 125% poverty guidlines which is about 54,000 USD. However, we don't have that much money in the account. So my husband has to go back to US, find a jobs in order to have US income about USD 18,000. Our plan is : he goes to get a jobs in US and pay tax for year of 2012 and then continue doing package 4.

So now, our case is pending in South Korea and waiting for the package 4, just stuck because of the affidavit of support...

That's why I have the questions above is like... Since my husband go back and have a job in US now(jobs starts in late Feb 2012) and his salary is above the poverty line now...

But I am not sure how long it takes to categorize as " the steady income" .. like how many months we need to wait ( in case we also have some saving in the account 20,000 USD in thai bank account + 10,000 USD in the US bank account )..

So for his jobs (working for a month or 2) + some saving + joint sponsor( self-employed,steady paying tax for 3 years but just started to her business this year) , is it enough to qualify for the I-846 to pass the process now?

Or we need to wait longer?

How many month averagely we need to wait to get successfully approved ?

Just need any experienced answers for this..
