HI

I have read the guides posted here and gone through many other forums but always find somethign that doesnt fully relate to me so I am still confused and unsure. Any help would be greatly appreciated.

My husband and I have known each other for almost 5 years, I live in the US he lives in the UK. I have visited him for one month in years 2-4 and 3 months this year. He has visited me 3 months per year the past 3 years. I just got home from my 3 month visit so am currently looking for a job. I have a bachelors degree. He works part time right now and has no college education. we got married on 09/09/2011.

I am just wondering if anyone can give us the info we need to apply for him to come over here with a few questions that arent in your guides.

As far as I know so far

I need to fill in the I-130, petition for alien relative along with G-1145, E-Notification of Application/Petition Acceptance

and attatch all of the relevent info, photo/birth certificate etc.

Then we would like him to come to the US while it is being approved, for which I need to file a K3 application.

Do I file that after they recieve the I-130 or do I send it along with the I-130?

(As a side question, does anyone know the average time between filing until my husband can recieve the visa to come to the US?)

Then when he is here we will get notice of how the process is going, interviews etc. until he is granted permanent residence on a 2 conditionary basis.

Is this correct so far?

Right now I do not have a job as I just got back from my visiting him for 3 months, though I plan to get one as soon as possible, though I may not meet the requirements to sponcor him until he gets a job here. We plan for my mother who I live with and we will be living with when he gets here to be his sponsor. Would that affect anything?

Also I have read in a few plases about filing a CR1 instead of K3 visa, though I cant find out exactly how or what this does, so any help on that would be appreciated also, thank you for your time. :help:

K-3 takes longer and costs more. Filing a K-3 does not have anything to do with him coming to the USA during processing what so ever.

CR-1 takes less time than a K-3, costs less than a K-3 and gets a green card on entry to the USA for the immigrant which means work and travel right away.

Filing for a K-3 is useless at this time - in the past it was meant to help bring someone to the USA faster when the CR-1 was not processing quickly. Now it is backwards the CR-1 is processing faster than a K-3, the K-3 is being closed / phased out by the NVC.

Right. Best to just erase everything you think you know about a K3. Treat it like it never existed. Follow the CR1 visa guide. Except for visits in either direction, you won't be living together for 7 to 10 months.

we got married

then filed for k3

they changed it to CR1 ...we did not know we should have done this. not sure if all get changed this way or not.

then we did all the forms and fees.

our local immigration office suggested we do it this way so she can have everything to work when she is ready when she comes over.

for us, it was painless. we had more pain on a personal level.. distance and time apart and fights. but we better and stronger now :)
