Ok so my wife and i have just moved to New Jersey this week and are ready to file for my 10 year green card FINALLY! (it took us 3 years to get everything to gather financially...but now we are ready).

So my questions are:

1) Should i do the change of address before i send in my papers or at the same time or what do you guys think is the best way to handle that.

2) My wife now has a new job and so will her affidavit of support be ok even though its a new job.

Well, the first problem is that you moved to New Jersey. :crying: Sorry, but I lived there for almost 20 years, and NJ can be a running joke for most New Yorkers.

When you submit your paperwork, you will be putting in your new address so I do not see a need for a formal change of address. As far as a new job is concerned, she can provide proof by using W-2's and prior years tax returns.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Almost every response to your post was wrong.

You have to inform the USCIS of your new address, regardless of filing before or after the ROC. Best is to send in your ROC application and at the same time submit a change of request form online.

Your wife's new job has nothing to do with your ROC. For ROC's affidavits of support are neither needed, nor submitted.

At this point they don't care how much you wife is making.

Just so everyone is clear, this is the first set of paperwork we are submitting since getting married 3 years ago, i just know that i can skip the 3 year card since i have been here that long. So because i'm going straight for the 10 year, does that mean they don't care about my wife's income regardless?

There is no 3 year green card. There is only a 2 year and 10 year card.

You need a new medical and all new forms most likely have to file the I-130 with the adjustment of status.

Since you did not explain this your question is in the wrong section you are not filing removal of conditions. Moving to adjustment of status forums because you are adjusting your status after being out of status and not living legally in the USA.

You need to file the I-130 together with the I-485 to get the 10 year card. You will also have to show the amount of relationship proof as you would for ROC. They expect more as you have been married so long. Not to mention a new medical of course.

I more or less have all the paperwork ready to go including the new medical. (I-130 and I-485). Its the affidavit of support that im having trouble getting from someone other then my wife. The Affidavit of Support is the only thing at this point stopping me from putting the package in the mail.

Well what you could do is do the I-864 and include a copy of the contract showing expected income. The problem with sending it with the "current" income being her PROSPECTIVE income (prior to her starting), is it's a lie because she's not earning it yet.

I would get it all together and send it on her first day and dated the first day of work (so it's not a lie). Worst case scenario they will RFE you and this won't be for a couple of weeks. Then they will give you 86 days to reply to the RFE. This gives her time to gather some payslips and a letter from employer. Bear in mind during the RFE period your EAD/AP applications are paused as well.
