I can not financial support my fiance to the required amount so I have a co sponsor to sign for him. This will be my stepfather and he is currently on workman's comp. He is receiving money.. is anything extra needed for him when filling out the form? Does he need a letter from his employer or the agency depositing the money?

Workmans comp COUNTS as income and your stepfather IS employed. "Employed" does not mean "working" and working is not "employed" He would attach the same documentation as all others including WC check stubs, etc. and his stated employment is his regular position.

I was on workman's comp briefly for a back injury which happened to be at the time we adjusted status. We had no issues at all. I did not want to delay the AOS until I went back to work. I asked around here at VJ, got the same answer I just gave you and I had no trouble whatever.

I agree that Workmans Comp and Unemployment Benefits do count as Income. However, they are Temporary Income and Non-Substainable. Workmans Comp Runs out after a Doctor Dianosis and the Employee retrained or return to work status, where-as Unemployment simply runs out. As you said Gary, I did'nt want to take the Chance and returned to work. I myself have been dealing with this. But I know Proof of a solid Income is required.

He doesn't get checks he gets a form and statement with his pay and can we provide a 50 for statement of employment?

Workmans Comp is something your Stepfather paid into and deserves that pay.

I give!
