Hello there! I have one question for you guys if any of you can help me a little it. So last year I got my wife in USA and we file taxes jointly because she didn't work that year. However this year is a different story she found a job and she worked. I was doing my taxes the other day with Turbo Tax and found that if we file separate married I will get more money. But she is on CR-1 Visa i read somewhere that when she files for citizenship after 2 years and 9 month might be a problem at the interview. Is this true? Is it a must to file jointly for all the past three years? or I can do this year separate and the 3rd year we can file it together?? Please if anybody who knows this for sure advise me how to proceed.

Is is better jointly or for this year we can file separate married and wont cause any major problems when she files for citizenship.

I will stand corrected on this by someone who may be more knowledgeable than I but I think this is how it works.

1. The IRS does not care what visa you have

2. You are married, so you can file married jointly, or married filing separately

3. use whatever one works better for you, return wise.

4. when you file for citizenship years down the road, both returns show you are married.

Just as the IRS does not care about visas, the USCIS does not care how you file a tax return as long as it shows you are married.
