Pasting this here did change my formatting slightly, but that is basically it. I also included a seperate cover for each of the two packets. Also, though not listed I also included a couple pictures from our wedding with the bonafide marriage evidence.

How are you qualifying for the I-864?

You also need another passport photo of the beneficiary and one of the USC.

If I need more pictures could you please explain where and cite why?

From my understanding of the required documents I need the following photos:

The I-130 requests one photo each of the petitioner and the beneficiary.

The I-485 requests two photos of the beneficiary.

The I-765 requests two photos of the beneficiary.

From what I can understand this is a total of five photos for the beneficiary and one of the petitioner.

Oh, i see the photos in your list now. Your photos are correct.

My question is about HOW you are qualifying for the I-864, not the code for your EAD. You say you include a letter describing why she didn't file tax returns, which makes me think she isn't working. So, how are you qualifying? You need either proof of assets or a co-sponsor if that is the case. I don't see any evidence for those things in your list.

Actually she is working. She manages a photo studio here, but back in Canada she was unemployed and I worked.

Because she had no income for the past three years up there she was not legally required to file taxes with the IRS.

I have attached the applicable tax 1040 instructions indicating that and a short letter describing the situation. I also included pay stubs from the start of January to present showing her more than acceptable current income.

Thanks for the input. I will wait around to see if anyone else wants to chime in. I forgot to get my wife to sign the I-130 cover letter, so I will get her to do that tonight and if no one else finds an objection I will go ahead and mail it off tomorrow!

Good advice...I was missing a signature on oe f my I-385's and had not printed my name in the bottom box on either of those, although I have read conflicting reports on weather that was necessary.
