AOS Big Problem, we missed our interview!!

People, HELP US! we filed to adjust her status last may. never heard a word. due to winter and financial difficulties we went south for winter to work. we had a nayber getting our mail. but USCIS sent a certified letter twice saying our interview was in december. we found out and requested a reschedule then never heard nothing. it was on jan 24th and we weren't there. we just returned home to get another certified letter saying our case has been deemed abandonned and denied pursuant to 8 CFR 103.2(b)(13). there is no appeal but you may file a motion to reopen or reconsider. with fee (of course) within 30 days of this notice (feb 8)! wife is coming from down south on monday. oh, and another disaster, she got ALL her IDs, passport,visa, etc.. stolen out of the hotel room last week!

the notice of decision from the field office director says also; the decision resulting in denial of form I-485 leaves you without lawful immigration status in USA and you are now here illegally. also any emplyment previously authorized is hereby cancelled! ( she had gotten a employment authorization card in april) As if it matters since it was one of the things stolen from hotel. Now what the heck do we do? We've got 12 days to file a motion. HELP!!!!!!!!!!

When you requested the reschedule you should have received a confirmation number, and they should send you a letter also confirming it. Do you have the confirmation from the reschedule?

Your other other option is to refile AOS.

You moved to another state and didn't notify USCIS?

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

5/23/12: Sent out package
2/06/13: APPROVED!

She doesn't have a GC.

Contact an immigration lawyer. This is out of a DIY process.

A while for USCIS is six months or more. That's a very well known fact.

File a police report, get a new passport and get a lawyer

Get a police report for all missing documents first and foremost. Then you will eventually have to refile.

If u can prove that u rescheduled b/4 ur interview date,they will send you another date 4 interview.They just need to see that prove.Do u have it.

get an infopass.Local office can help u with that but with proof that u rescheduled b/4 & the last letter u received 4m USCIS
