I have a friend that made a false claim as a USC at the Port of Entry in San Ysirdo. The purpose was not to immigrate to the USA, but just to explore something new. Well, she's talking about doing a Tourist Visa and not a permanent stay. How likely will she be will be approved or will it be a straight denial? She has not will to live in USA, as most of family is in Mexico and steady job.

your 'friend' is permanently barred from receiving a visa for the rest of her life.

While theoretically he/she could obtain a nonimmigrant waiver (212 d 3 a),she would first have to convince the VO that she does not intend to remain in the US nor work illegally...but since your friend has already shown such a strong willingness to disregard our laws, who in the world would believe a word she said?

And as for marrying some Amcit in order to get a green card, well, there is NO waiver whatsoever for someone to obtain an immigrant visa....period.

What happenened when she made the false claim? Did she present fake documents? Verbally say she was a USC? What happened then? Was she detained? Deported?

This is not a good situation for your friend. However more details the better

Was caught giving a US birth certificate and an ID (of herself) to the CBP at Port of Entry. After detention for a few hours was sent back to Mexico with just a detention receipt.

During the interview before being sent back, she asked one of the officers if she SOS from coming to the US in the future, he just stated apply for a non immigrant visa, it's her best opportunity to see America.

That's why I asked what are the chances.

Your friend committed the absolute worst crime against immigration, it carries the harshest punishment.

Her chances of legally entering the US are somewhere near that of a snowball fight breaking out on Miami Beach on the 4th of July.

We can get snow on the 4th July, but no where near Florida.

So why do Americans get the 4th July the right way around and all the others backwards?

Nothing states that you friend cannot apply for a tourist visa, she will, however, not be issued one. She will never be issued one.

Not an immigrant nor a non-immigrant visa is in her future.

She is, for lack of a more appropriate legal term, 'toast.' Reasons do not matter....no one will care about her motivation for having done this, her Twinkie consumption habits or desire to 'see America' or any other reason will be moot...this sort of action is deemed the worst of the worst, because no one really knows what her true motivations were (no matter how well you may think you 'know her'.) And I agree...our country does not need nor will suffer from the absence of, anyone who tries to gain access to MY country by falsely claiming he/she is a citizen of MY country....I would recommend taking some Spanish lessons and consider strongly visiting Mexico on a regular basis, in order to visit your 'friend.'
