I have my EAD but my husband wants me to get a job after the interview which is little over 2 weeks later. He told me what if my works tells me to start the work on the interview day lol.

Anyways, my question is, when I apply any job in US with GC, all the jobs do back ground check on their candidates, when they do the back ground check, would it tell the employer that I was illegal for the time being till I get my GC?

Let's assume that I'm not applying for any goverment/state/city job since I'm not even quailfied for that due to not being a USC.

12/05/2011 - Delivery confirmation via USPS

12/16/2011 - Received emails for I-130, I-485

12/22/2011 - Received NOA in mail for I-130, I-485 dated 12/16/2011

12/23/2011 - Received rejected I-765 due to missing signature

12/24/2011 - Received biometrics appointment on 01/09/2012 dated 12/20/2011

12/27/2011 - Reapplied I-765

12/29/2011 - I-765 has been delivered by USPS confirmation

01/04/2012 - Walk-in biometrics done

01/11/2012 - Received NOA in mail for I-765 dated 12/30/2011

02/01/2012 - Received text/email for I-765, Card/Document Production

02/06/2012 - Received EAD card in mail. YAY!

02/07/2012 - Received text/email for interview date, 03/15/2012

02/08/2012 - Received interview letter in mail

03/15/2012 - Interview at San Antonio, approved on spot and got a stamp!

Believe it or not my actual job (not training) wanted me to start on my interview date, but I told them beforehand that I would need that one day off. They were very accommodating! You are allowed to work, you have your EAD. There is a space for people with Employment Authorization (this will be after you receive an offer of employment) so you need not worry (it should say "are you legally allowed to work in the U.S" on the actual application). If you did not have you EAD, then I would be concerned...

Your worrying to much about Nothing. You would not be in the US if there was something wrong and you will pass a Background Check, additionally, DO NOT say anything about illegal status because it does not apply. Your here are'nt you. Your LEGAL.

Your husband needs to take a Chill Pill. I'm sure your already Nervious all by itself.

Be Confident in your Quest to find work. If you have your EAD then just apply for work. Nothing else said by you. YOUR LEGAL TO WORK HERE. Find something you think you will like.

Thanks yall. I know I'm legal and I can work here since I have EAD card.

My husband was worried about starting the job on the interview day because it's a bad example to ask for the day off on your first day, not about being legal or not.

And actually my qeustions was, specifically, Would the back ground check be able to tell about my illegal PAST or not, not about my legal status right now.

Possibly. But it depends on 2 factors:

1) What background checks are used.

If an employer simply uses E-VERIFY you should be fine. E-VERIFY acts as a snapshot to comment on your current immigration status. You have an EAD, so any employer searching will be told you are legal.

If however an employer opts to do a criminal history check, that will show any arrests (and whether or not that led to a conviction).

So that leads to factor #2....

Were you ever arrested or detained for being in the U.S. illegally? If so, that WOULD show up on a criminal background check - and would highlight your illegal past.

If you were not arrested or detained, I can't see how a standard criminal background check would show your illegal past.

As an aside, you mention in your OP that you are not a USC therefore not qualified for government/ state/ city jobs.

That's not necessarily true.

Yes, most Federal positions are reserved for USCs, but the majority of state, county and city jobs are open to anyone with a valid EAD or Green Card.

I'm only an LPR, but I'm an investigator with the Colorado Attorney General.
