So i met a girl and she is separated from her husband. we have been together for over a year now, and I was wondering why she can't just get a new visa. she always says that if he finds out, she will get deported. here is the catch... she was physically abused by him... please someone help me!!!

I have no idea.. Is she just suppose to stay married to him and wait out her visa? Or is there anything at all she can do??

Do what ? To legally stay in US ? Are you a US Citizen ? You can petition her then once she is divorced. Provide more details what situation looks like and what are you attempting to do...

Some more detaled about your case would be great. Just so you know here is what you are up against.

She is on and L2 visa.....This visa is give to the SPOUSE of an L1 holder. If she wants to divorce her husband that would make that visa void since they are no longer married to that L1 holder.

If divorce is the route she wants to go I would definitely be prepared for her having to go back to her home country. From there you both can apply for another type of visa, based on how ou move forward in your relationship.

Yes I am a US citizen. She has another year left here, but she tells me if he catches whiff of her seeing anyone else he would cancel her visa. She tells me she has talked to lawyers who tell her that she is doing the right thing but just playing it out, but either way, isn't she going to have to go home eventually? Whether it would be him cutting her off, or the length of the visa coming to an end?

Your L2 is only good for a certain time, it has to be renewed. So yes she can stay until her time is up on that visa, once its expired she will have to go home.

She can go back to her home country and file for divorce.

She can file for divorce in US, but the time between the divorce and time you get married (assuming you are USC) she will be out of status.

Yes marriage is a possibility. How long am I looking at her going back to Canada?

I mean like immediate marriage after divorce, by going this route chances are your AOS would be difficult coz she will have to divorce and immediately get married.

Best option would be she go back home file for a divorce and then you can either file for fiancee visa or go to CA get married and file for CR1.

Unfortunately there is no GF/BF or dating visa.

Dating someone who is legally married is not accounted for in the law. It is quite messy. She has to be able to pursue a relationship in the eyes of the law. So you have to wait until she is legally available to start any process. That is the way it is.

I dont think if OP was asking if he can date or not, the only reason I pointed out the point in my post is coz he wanted her to get divorce then he would have to marry her. He will not have a choice of date first and then make decision if he wants to marry her or not.
