I got F2b petition with my 2 sons (age 13 &10). We are still waiting for our interview in local embassy. Just want to ask if after my sons enter USA, say for a month or 2. Can they come back to Philippines and continue their studies? As for me, I'll stay in USA and work? If so, what will be the procedure and how long they can stay in the Philippines? Thank you so much for your reply

Lawful Permanent Residents who stay outside of the U.S. for 6 months or more at a time are risking losing their I-551 Green Card (Lawful Permanent Residence) to airport immigration officials when they try to re-enter America. One way to help prevent the loss of Lawful Permanent Resident (LPR) status due to an extended trip abroad (whether it is for 6-12 months or for longer than 12 months) is to apply an getting a special two year I-131 ”Re-Entry Permit” before leaving the U.S.A .Do not allow them to leave the USA before getting the Re-entry permit in their hands.Without an approved Re-Entry Permit, green card holders are required to spend at least the majority of the year in the USA to keep their green card.

Why are your boys, ages 10 and 13 F2B preference?

Second Preference (2B): Unmarried adult sons and daughters of permanent residents

Your boys should be F2A.

Second Preference (2A): Spouses of green card holders, unmarried children (under 21) of permanent residents

Read this and this with regards to how long your boys can stay in the Philippines.

The OP is probably the principal beneficiary and her sons are her derivatives.

Why are you sending your sons to school in the Philippines? If they are planning on going to college in the US, they may as well start competing with US students now in middle school and high school. In addition, there is no risk that they will lose their green cards.
