I have my appt. on march 2 and it's to submit my Perdon...... I'm really nervous and would like to know if anyone knows what my chances are on getting approved right there and then???!!! I am married to a USC and we both a clean background , we have a 2 yr old and we've been married for 3 years.. We have lots of pictures together and his father is really sick back in California ... Could that help me since he needs my support? We are putting that in the Perdon we are submitting... Help please.. I just want to know what my chances are

Are you talking about to submit a waiver, right? It's the I- 212 or I-601?. Are you in the USA or in your home Country?

Your husband he USC citizen must prove “extreme hardship” if he has to leave the USA to be with you in your home Country. Your husband needs to write a clear and detailed letter explaining each situation and circumstance that will cause “extreme hardship”. It is not enough to say that he will miss you, he will feel sad being apart from his son...

The best way to approach the hardship letter is show to the USCIS about every aspect of how his life would change if he has to relocate permanently to your Country, each argument must be supported with evidence. Hardship can be demonstrate in many ways, such as

1-"health/medical" Is he doing in the USA any treatment for a health problem? if the answer is yes them show to USCIS that the availability and quality of such treatment in your Country is not good,search in the google, and attach some prove of that.

2-FInancial and Jobs -Is he working? let them know what he does in his job, salary and compare how would be is he gets a job in your home Country, he will decline in standard of living; cost of extraordinary needs such as special education or training for children; cost of care for family members .

3-EDUCATION - Is he studying or is he planning to go back to study? show to USCIS he has better opportunity for higher education in the USA; requirement to be educated in a foreign language or culture with ensuing loss of time for grade, show them the opportunities your child will have living and studying in the USA.

4-PERSONAL CONSIDERATIONS - If his parent or one of them is sick or living in disability and need your husband around to help them to take to doctors appointment, check up on them frequently etc...let them know that and prove, siblings, and close relatives live in the United States

5-SPECIAL FACTORS - Let them know the differences between between the USA and your Country regarding Cultural, language and religious.

Show them the differences between the USA and your home Country regarding violence,jobs, health system, educational system, his ties with his family in the USA. He needs to prove he will suffer leaving the USA to leave abroad with you. Do not waste time saying about how much you love him, how much he loves you, miss his son...you need more than that, you need to prove hardship regarding your husband, the US CITIZEN, if the USCIS deny your permanency in the USA or do not allow you to return to USA , and he has to leave the USA to be with you and your son in your Country.

Once you show everything I mentioned and prove you will be ok!.

Btw: You said his father is sick then include personal letters from his doctor, medical records, prescription information, etc.
