For the I-130 packet I will be including the Passports (new and old) of my spouse who is the beneficiary and I will also be including my new Passport. The passports are not needed if I show my birth certificate and not needed at all for the beneficiary, but since they will show bonafide evidence of us spending time together they will be included! They show that my spouse has visited me here in the USA 5 times and that I visited her in Romania 2 times.

So because I am including unexpired passports for the both of us, what would be the advantage of showing any birth ceritficates?

NONE! right?

if I am wrong, what the advantage of including the birth certificates for any of us?

my goal is to reduce that chance of getting an RFE.... but if the birth certificates are not needed then wouldn't giving them the extra documents make USCIS more angry because its more paperwork for them to look at?

You mean that you're gonna send photocopies, not the actual passports, right?

Well the beneficiary birth certificate is definitely not needed at this stage, and for the petitionner, it's birth cert OR copy of all pages of the passport.

So no, you don't need any birth certificate in this package.

The American Citizen can send a copy of the birth certificate OR passport

The alien MUST send a copy of the passport AND copy of birth of certificate, and respective translation

NOT true, :guides:

NO proof of the alien spouse identity is required in the I-130 package.

All this will only be necessary at NVC stage, and generally translations are not needed if the documents are in the language of the country the interview will take place in.

Well the beneficiary birth certificate is definitely not needed at this stage, and for the petitionner, it's birth cert OR copy of all pages of the passport.

So no, you don't need any birth certificate in this package.

right! I am going to include a high resolution color photo copy of all 3 passports and include all the pages. You can fit 4 pages of a passport on one letter size page with no reduction in size! (as advised, I will only print on one side of the copy paper)

I am also going to show an extra copy of the Passport pages that show the stamps of our visits between each other and with a blue pen to write down the dates on the page. (I will include these extra passport page copies in the bonafide evidence section of the I-130 Packet).... good idea?

Don't bother: the beneficiary birth certificate will be required at NVC ONLY, and then, even if you already submitted it to the USCIS (without any reason to do so), you'll be requested to submit it again to the NVC.

Don't bother: the beneficiary birth certificate will be required at NVC ONLY, and then, even if you already submitted it to the USCIS (without any reason to do so), you'll be requested to submit it again to the NVC.

Not necessary. Your passport photo page with biographic data already shows that you are a US citizen. Feel free to include a birth cert if it helps you relax but you don't need to :)

The foreigner's passport data page and the birth certificate with translation are not needed at the petition stage. They are needed at the NVC stage.

Correct. No need for either birth certificate at this time if you're sending both complete passports. Yours will serve two purposes, evidence of US Citizenship and evidence of relationship.
