Hello im new here i wish i would have this site earlier :/.

i came to the u.s on a k1 visa i was supposed to apply for AOS this last december but my husband lost his job and we couldnt find someone to sing the affidafit of support :(( now my husband has a new job and we will be sending AOS.

Are they gonna denied because we file late?

help please!

There is no deadline for filing AOS, you won't be penalised or denied for that. You may need a new medical if it has been more than a year since your K-1 medical exam. If you have been married for more than 10 years you should consider filing the I-130 along with the I-485, as you would qualify for a 10-year green card instead of a 2-year green card.

Oops, sorry, I meant to write if you have been married for more than TWO years you can get the 10-year green card

If it's been more than 2 years you should also file the I-130 in order to get the 10 year card. If you haven't filed the I-130, even after 2 years of marriage, you will get the 10 year card (if you get a 10 year card without the I-130 it is in error and you will need to report it to get it fixed).

If it's been more than 2 years you should also file the I-130 in order to get the 10 year card. If you haven't filed the I-130, even after 2 years of marriage, you will get the 102 year card (if you get a 10 year card without the I-130 it is in error and you will need to report it to get it fixed).

I apologise there is a typo above. You MUST file the I-130 to get the 10 year card if you've been married more than 2 years. You will get a 2 year card if you have been married more than 2 years (on a K1) and fail to file the I-130 due to rules that state a K1 MUST have a 2 year card first (the I-130 overrides that).

I'm sorry for my earlier typo. As you've been married more than 2 years you should file the I-130 and i-485 together. You will get the 10 year card that way (no need to ROC). Remember you will need a lot of relationship evidence due to the length of your marriage (they assume you have more).
