Hey guys, I'm applying for my K1 visa application for my fiance, she is in Pakistan. Do you guys think that it will be problem that I am married to her over there? I just got my naturalization complete and became a US citizen, but I said I am single b/c I wanted to apply for a fiance visa instead of a spouse visa b/c some people told me fiance visa is a bit faster.

you already did nikah with her in pakistan?

If you have already married her even in a religious ceremony such as a nikah then you CANT file k1 You must file CR1 otherwise its misrepresentation and lying and it can cause you to have a denial and a ban.. possibly for life

Yea I did nikah with her in pakistan. It is a religious ceremony in our country so technically it isn't recognized in the USA correct? Do you think it will cause a problem here in the states, or over there in Pakistan when she goes for the interview?

doesn't matter.. you married her.. it may be just a religious ceremony but by all accounts you ARE married! Yes it will cause issues because you lied. And it IS recognized.. I did nikah too... we applied CR1 visa.

No man, I just joined the forums. Got my naturalization completed this week. became a US citizen. I will be filing for a K1 visa for my fiance, to whom I completed a religious ceremony in my country. I also have a few questions regarding the items they're asking for.

for example, there is a item they need from the fiance...a statement from her saying she approves of marriage with me in the USA. how would she go about getting that over here? would she sign it? and would that be approved by some judge over there?

whats a CR1 visa? so you're saying that i shouldn't send the I129F form? and is your fiance here already? how long does the CR1 take?

CR1 is for married ppl and you can see the timelines how long it takes.. I'm telling you that if you did NIkah in pakistan you are NOT single your married you can't file for k1 visa you need to file CR1 visa but you do what you feel you need to do.

We did ours the way the law says to do it.

its mis rep in a very bad way... this guy needs to see a lawyer and tell the lawyer that he lied on the naturalization because as soon as he files they will know he was married before his nat when his nat says single...
