Hi everyone,

I'm planning to apply to petition for my brother to move over here basing on F4 category, and I have some questions here, hopefully someone can help me out.

My brother has been married 2 times. The first marriage didn't work out and he got divorced with no kid years ago, then moved on to the second marriage which is good till now. Unfortunately, he lost all of paperwork regarding to his first marriage, including the marriage certificate as well as the divorce decree.

Questions:

Can I NOT list his first marriage in form I-130?

or should it be a good idea to put info of his first marriage down in form I-130 with just a divorce year (no exact date)?

Later on when the time comes, would the consulate ask for his divorce decree at the visa interview?

You must list about his first marriage. Please ask your brother to obtain the duplicate copy from court system. It is very important. Failure to provide correct info, it would delay his visa, and will make unnecessary trouble.

Since it is F4 category, it is going to take almost a decade. So better to fill correct and true info to avoid any trouble for future.

he must tell the truth, the wait is over 10 years, so he will have time to get all the documents needed. he will need the documents for the NVC stage, for his wife to come with him.

I know the waiting time is a decade, and I'm about to apply the I-130 now cuz his little son might be at risk of being overage by then, so can I just fill info about his first divorce down in I-130, but will put the year of his divorce instead of full date and year? Then he will request a duplicate copy from court, and will have the copy ready to show the consulate at the visa interview when time comes?

if he remembers the complete date, he must fill it out. as I mentioned, the documents will be needed at the NVC stage, before the interview, in order to bring his wife and children.
