If my wife is pregnant, would it have an effect?

Just curious, if me and my wife were expecting our first child, would it have an effect on our case? Could we request to have it expedited since we'd like to have our child be born in the US? Would there be any negative effect on our case, for example, during the medical exam?

There wouldn't be any negative effect. Unfortunately, there wouldn't be any positive effect either. In the USCIS' eyes, she could just as well give birth in the Philippines. In other words, she doesn't HAVE to be in the US to give birth.

For a medical condition of any kind to qualify for an expedite, it has to be considered "extremely emergent." Basically, her health and the kids' health would have to be at a severe risk.

The only other way in which a pregnancy could qualify for an expedite would be on humanitarian grounds.. As in, i.e. there is no competent or functioning health care system in her country.

Won't help or hurt (so no, no expedite) BUT she will need to still do the x-ray for TB with the protective shield over her belly. If she doesn't she'll have to wait till she gives birth to complete her medical.

Unfortunately the gov't doesn't care. I was 5 days short of giving birth when my husband was transferred from county jail to immigration detention and although a guard asked if I had given birth ultimately they couldn't have cared less.

No no difference, if that was the case everyone would get pregnant to hurry things up lol

However, the child can be an american anyway, you guys can start preparing the paper work so you have it all done when the baby arrives and send it to your embassy. It's fairly easy, I'm in that situation, our child will be born in sweden but she will have dual citizenships..

Hey there!! I was in a similar situation. We sent away the I-129F July last year, found out I was seven weeks pregnant in August. There is no real way to speed it up but we DID send in a letter with packet 3 telling them the situation and we would like for me to have the baby in the US.

As far as the medical goes, I got that as usual but no x-rays or vaccines. They will be done when I have had my baby in May and that is when I will apply for my AOS.

I hope everything works out!!

No X-rays for women who are pregnant or THINK they could be pregnant. Pregnant women cannot even be in the vicinity of the x-ray room. That applies here in the US of A. Don't know about other countries and if they are aware of dangers of radiation to a fetus, but I think they should. The Embassy/Consulate should not demand an x-ray for a pregnant woman.

They don't demand it. They just won't approve the visa without it. So you either get it to get the visa, or wait until after birth.

if you read the link I posted it depends on what version of the TB instructions they're using. The most recent instruction don't allow for the waiver. The 1991 instructions DO allow for the waiver. I would assume most have upgraded to the new instructions and the OP should assume they have unless they learn otherwise so they know what path they will take if faced with the decision.

Yet they do. They require to have it done with the use of a protective screen on the belly. For IR1/CR1 visa there's no other medical examination once in the US so it's before or never.

They recently changed the requirements for the chest xray (like in the last couple of weeks). I am pregnant and required a chest xray this week and I don't come from a high risk TB country. Now all adults must have one. You don't have to get your vaccinations though (I didn't need any though).

Not everyone would get pregnant to hurry things up....jejejeje....I get a kick out of that reaction, interesting that people would get pregnant to speed up a visa, I suppose if someone was already planning on starting a family immediately, that makes sense.... :thumbs:
