Hi guys,

We finally made it. I am in New York and we got married. Now we're filing for AOS. I have a question and I need help as soon as possible. When I had my interview appointment in Italy my fiance filled out the I-130 and also I-864 (just in case). At the embassy they didn't it so we thought we could use it now for AOS. The problem is that the date in those I-864 is October 2011. Is that ok? We just didn't want to start over since it's there ready for us.

Thank you

Yes it will need to be redone. You also don't need an I-130 for AOS from a K1.. unless you mean I-134 that you submitted at the K1 interview...

Yes I mean I-134. I read that it's fine. I'm confused now.

I'm confused about why your husband has an issue with printing the I-864 again and resigning and re-dating it... (reusing the tax return info is of course fine). Why won't he just redo it? It's not a big deal. Why would you risk an RFE for a simple thing? If you want to try sending it go ahead. It might be fine but it makes no sense to risk it when it's a simple fix.
