Parent of a permanent resident, are there any special cases?

Hello,

I was wondering : I know as a permanent resident you can petition for some people in your family but not your parents.

Have you guys heard of any special circumstances cases when it happened? For exemple, my mother who is alone has alzheimer's. It's not full on but I'm scared of leaving her behind for 3 to 4 years.

Have you heard of people being able to bring one parent if they can't function alone? or maybe if she became legally dependant on me, like if we got me responsible for her... something legal like that.

So yeah, just wondering if you guys ever heard of any "special cases" existing when it came to permanent residents and a parent.

No. Is such case you'll be advised to stay with her rather than go. Simple as that.

unfortunatly not, there are no exceptions to file for her, there is no category for resident petitioning parents. you have to become a USC.

Not only are there no exceptions in such a case, it may actually be near impossible to import your mom to the U.S is she is in need of special medical attention. If your mother can't work for at least 10 years full time, she won't be able to pay into Social Security. Less than 40 quarters of payments means $0 per month in retirement money. That's not much. In addition it's highly likely that the consulate will require you to proof that your mom will be covered by health insurance in the U.S. This goes well beyond the requirement of the Affidavit of Support, because Uncle Sam wants to make sure that no foreigner will become a public charge on the American people.

Since you can't petition for your mom at this point anyway, this is a moot subject. Just be aware that even after you have become a U.S. citizen, getting your mom over here may not be possible, unless you are independently wealthy or this country's health care system gets the reform it desperately needs.

Thank you guys, leaving her there I dont think so lol it was always just me and her.

But what's this about working 10 years, haven't others old parents got their visa? She's got her own retirement money and money aside she was never gonna use anything that's not for her to use French expatriates have z way to get French social security abroad.

Where in the process wouldn't they let her? The medical?

oh and i read a topic about old parents here, and they say it's about insurance, my fiance sells insurance so we'll get her something good. It should be fine with our income and hers and the good insurance, we'll show she won't be a burden to the country. but thanks for the heads up about all that!!

Unfortunately, NVC makes no exceptions. My 17 year old sister was current when her father suddenly passed away. I requested an expedite since my mother was petitioning for her. They denied it of course, they had all her paperwork it was just siting waiting to be reviewed. By the time they stamped it as complete we retrogressed. All you can do is wait and hope, try to look out for her from here. Good luck!

You and your So should look into what type of care will be available in your area for patients who have alzheimer's. If you plan on working, this will be a hugh burden financially and daily care to care for your mother in this stage.

Please look into this, this kind of responsibility on one person is a heavy load to carry.

Does your fiance sell health insurance? I agree with Boiler. Ask your fiance to get a quote for health insurance for your mother. I think you'll be shocked. $2K to $3K per month for someone who has already been diagnosed with Alzheimer's would not be unusual. That's $24K to $36K per year. That might even be a low estimate. Can you and your fiance afford that? I know it sounds outrageous, but the truth is that one stay in the hospital for more than a day would probably cost more than the annual insurance premiums.

When making the public charge determination, they look at the immigrant's ability to support themselves, the likelihood that the immigrant would become a public charge without support from someone else, and the sponsor's ability to fully support the immigrant. Your mother will be unable to support herself. If she doesn't receive support from someone else then the likelihood of her becoming a public charge is virtually 100%. They are going to look very closely at you and your spouses ability to support her entirely, which includes her health care.
