My Fiance has requested 3 years Tax transcripts/returns for me to take with me to my interview but the IRS have only sent him 2008,2009 & 2010. If my interview is in April will i need his tax return from 2011? He just tried to request this on the IRS website but they said 2011 isn't available.

Sorry i'm not sure how the whole tax thing works in the states so please forgive my ignorance! :)

Any help would be greatly appreciated

I had my interview in London last April and I needed the latest years of taxes which was 2010 at that time. My husband had his taxes done in Feb (I think) and I had the transcripts in time for the interview. Once they are available it doesn't take long to get them mailed out.

Send copies of the entire 2011 filing and if that's not available, then it's not available. Current income represented by the pay check summaries are best.

Taxes in the US cover Jan 1-Dec 31. So we just finished up the 2011 tax period. Now we have until April 17 to file a return. Most people wait the month of January for arrival of their W2 statement of 2011 earnings from their employers and statements from banks or investments that paid any interest money during the year. So Feb to April is a busy season at the IRS---processing returns and issuing refunds. If your fiance has filed 2011 already, they may just not have it converted to a transcript format because it's busy season. He can print out the pages in his tax return and photocopy his W2 for you to take. I did that and also signed and dated the photocopy of the Form 1040. I was told my transcripts wouldn't be available until November for that year. (I think it was because I had a complicated paper return that year.)

Normally until April 17 (filing deadline) they can't require a return for 2011. If you interview in April then you will be close so getting his 2011 would be good even if it isn't in transcript form.

London is not that strict on the I-134. Only one tax return is enough. If he has other solid proof like an employer letter and recent pay stubs, they have accepted that with no tax return.
