hello every one

i have been refferel to this web to get some help

here im i filed for my I751 removal of condition on my stutus after i got divorced after one year of waiting i never get any latter from ins so suddently i recieve a latter saying that my application got denied and they forward my case to court base on i didnt submit enought evidence to establish a good faith mariage even i had submited alot on my side

so i was married to my ex for 5 years and we were living together and we just have some issues

any help would be apprecaite it thx u

Can you explain to us in some more detail, such as how much later did you file for ROC, what did you filed with, did you file the ROC as still married or divorced.

Did you ever received a Request for Evidence (RFE)? We have a member here whom never received it in which USCIS "denied due to abandonment".

Explain to us in more details so we can help you on this.

You need to see a lawyer. You will be going before an immigration judge to have your status revoked. You need legal representation if you hope to fix this.

sure guys and thx you for looking at my concern

my mariage was full of lot of stress after my mother in law passed away my wife become too aggressive and absusive and she just wanna her way only i try to take her for consolor and stuff like that and she always refuse so one day we had argument and the next day without telling me she went to ins and file a statement taht i dont love her any more and i used her for GC ..... ECT and in that time we still live togther under same roof after couple days later we had a argument again then i left the place that she can calm down and we figyre thgs out not shortly i got pick up by ins ICE

I HAVE BEEN CHARGE WITH entering mariage in fraud based on statement she submitted to INS so i been in detension center for 2 months waiting for the court day that time i have temporary green card valid till 2007 on my court day she show up at the court in front of judge apologizing and asking judge for forgivness that she made a hug mistake with her allegetion so the INS continue the CASE and fanilyy judge said look madam this mariage is real u just been over whiled with ur mom dad so nw take ur husband and go home

so i got released same day and i went home with my wife we start living togther again and every thgs went just fine after couple months her sister got sick and she had cancer so she said to me i have to go and see my sister i said ok babe go head and she fly to russian same time my GC exprired we were in touch we agree that she would stay only for 1 months thgs took diffrent direction there and she had to stay with her sister cus got no body to care abt her in mian time we were on the phone evry 2 days talking so i lost my job thigs got verry bad faniacilly with me after my green card expired ......... 1 yr and 6 months later my wife come back to usa and we live togther cus we still married she apologized to me abt unconvient situtation and how long she stayed there so we start putting thgs tigther that we file for removal of condition on my green card then we start arguing cus we had no money and i didnt have no job so we agrue and .......... up and down till one day she smoked some stuff ...... and then she was mad at me and we start arguing she treathen me with a lot of thgs ..... then i was sleeping in ours bed the only thgs i knew was police knowing in my door i open and they pick me up ........... guess what happend ......... im sorry guys i have t take a break i get so stress remmbering thgs like this .........i ask the office what i have done why u guys taking me too .. she my ex went to police and put charges on me verry ugly charge...... god verry bad days 2 days later in jail i found out that im charges with 5 felonies ......i was detained for the 2 time again from her in jail this time for criminal charges i spend 3 months in jail waiting for court days in my 2 hearing in front of judge they said to me u r innocent man and all the charges ur wife did put again you so they set me free then i file for divorce after that .... 8 moths later i file for removal of condition and i got denial ..... based on her statemt in the first time they think that i did enter this mariage to get the benefit of us spouse any help would be apprecaite it thx you

I see. I think you need to fight the accusation she and USCIS charged you with.

Get a lawyer, your situation is pretty tough.

I know money is probably an issue with you after all of that drama...but you need to lawyer up and lawyer up good.

Your next stop is status revoked/removal proceedings.

Your GC expired and you didn't file for ROC until 2 years after the card expired and now it's a year later than that so your card expired 3 years ago? Your status was most likely already revoked before you filed for ROC.

You NEED to see a lawyer. It's unlikely they will permit you to stay because you have no valid reasons for not filing before your card expired and because it's been so LONG since your card expired.

sorry to hear like this story , i don't understand why poeple decide to get marry if they can't fix a problems , if she became be agresive you must be know the reason and to fix it then help her to be calm , living together is not a simple thing , your life must be with respect before love , anyway try to fix it , and you must be in good and worse , i hope to sit down you and your ex wife and try to understand why all that happend suddenly and try to fix it;

I am sorry to hear your story. Wish there was some information of value that i could share with you. For now, as mentioned earlier, you need to find a lawyer to represent you. I hope things work out for you. You may have to find a way around to hire a lawyer as you mentioned you are in a financial mess as well. Good luck!

You should get a lawyer. You took too long to file ROC.

I'm sorry to hear what happened in your marriage but not to take your wife's side sometimes ppl deal with traumatic situations differently. She lost her mom and then her sister got sick with cancer which is another life threatening issue, maybe it was too much for her to deal with and she reacted harshly. I know I lost it for a while when I found out my husband was sick.

I wish the situation didn't reach the extent it did but one thing for sure is you're given a time limit in which to remove conditions and you didn't do it within the given time.

To the OP, make sure that you get a lawyer. Your situation is more complicated and they have experience dealing with these types of issues.
