Hello All,

Here is my messy situation.

My H1b1 Visa will expire in 6 months. And 2 years ago (after i got my renewal done) I openned a shopping kiosk with my social on my name and paid my taxes on it. This is without knowing that my h1b1 prohibits this.

After learning this I closed the kiosk.

Now my time is almost up. I am pretty sure they will not renew my work permit because of this.

When i first got my h1b1 there was no mention of tax documents nor any previous income information. So I am now planning to change jobs to get out of this mess but not sure if this would work.

I hope i got all the info thats needed here. Will this work. Any ideas?

If you want to change employer, you will need to file for another H1b status. On the first one, you came here from another country, so you wouldn't be asked for US tax returns. With the new employer, you are switching from another H1b status. With the second one, you should have file taxes on the first job. This is why US tax documents are needed for the new employer and why you couldn't have any for the first employer.

You've violated the terms of your H1b, so what is done is done. You are required to file tax returns on your business. You will need to come clean and disclose them on the new application for H1b status with your new employer. If you fail to disclose this information, you would be making a material misrepresentation that could make you deportable.

Go consult with a good immigration lawyer.
