I applied for an E2 investor visa at the London embassy in 2010

I was interviewed on 1st July 2010 and due to past convictions 15 years ago and failing to declare them on previous USA trips, I required a waiver of inadmissibility (under 212(a)(2)and (6)) which the interviewing consular officer recommended be issued.

This waiver was granted by DHS along with the E2 Investor visa 6 weeks later on 17th August 2010

I've since invested 1.6 million dollars into my property business in Florida I have sold over 60 houses and have 20 properties for sale or under refurbishment at present.

I went back to London embassy 14th July 2011 to renew the waiver and they said they would recommend a 24 month waiver this time to save me returning again in 12 months, I thought it would take up to 6 weeks as long as the 1st one did or quicker as this was a renewal as opposed to the initial granting of waiver which I assumed would require more security checks etc.

It’s now (as of 21st feb 2012) been 31 weeks since my interview and I have no idea what’s happening, I return to the UK approx. 4 times a year to see my children aged 8 and 12. I last returned to the UK 9th December 2011 and cannot return to the USA. I knew I was taking a risk returning, but children are obviously more important so I hoped the AP would finish by end of the year. I'm stuck in the UK and don't know whether I should close the business as it’s hard to run it from UK. My main subcontractor has already had to lay some of his workers off because I am his main employer.

E2 visa unit London say it’s out of their hands and with the Visa Coordination Unit. VCU unit say it is still in administrative processing with DHS in USA. I telephoned DHS in USA today and they say I am showing in status until August 2013. Perhaps this is why nothing is being done as somebody thinks there is no urgency here. I was admitted for two years on USA entry in August 2011 but when I left if December 2011 to see my children in the UK I was unable to return.

Nobody seems to know how to find out what is happening. Its been in AP 222 days which seems crazy since initial waiver took 42 days. Can any members here offer any advice as to who to contact to try to resolve this, is there any email addresses which may actually look into this instead of sending auto template response.

I hope someone can assist or point me in the right direction.

Also hope this is posted in the right forum.

Thanks in advance

Terry F
