green card holder wants to apply for her daughter in us

Hi,

my sister is in united states right now (27 years old) and my mom wants to apply for her green card,my mom got her gc in 2005.it is really confusing to figure out how long the process will take when i check uscis web site.My sister has to stay in us till she get the gc?also if my mom wants to she can be a us citizen,she is married with an us citizien.please give me a apprx. waiting time in this situation.she will apply at texas field office.

the process will take over 8 years, if your mom becomes a USC, the wait is over 7 currently. the problem is unless she is legally in the US all the time with a work visa o student visa, your sister doesn't qualify to adjust status in country. She would go through consular processing in her country of origin. she will need a wavier to overcome the 10 year ban that she will have. and your mother will have to do the hardship letter.

Your mother can petition an application for a visa for your sister. But, your sister CANOT wait out her time here for the approval and visa availability. The approval and visa availability can take over 7 to 8 years. Why do people keep trying to take short-cuts when there are none.

First your sister is 27 years old. If she is not married she would fall in (F2B CATAGORY) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation and as last bulletin the CUT OFF DATE for this catagory is 15 NOV 2003 thats about 9 or 10 year wait.

But if your mother becomes a US Citizen and she applies for your sister as a US citizen she would fall intoFirst: (F1 CATAGORY) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference. The last bulletin cutoff date is 01 FEB 2005 and the wait time is about 7 years.

THATS IF YOUR SISTER IS NOT MARRIED. I WOULD CONSULT A IMMIGRATION LAWYER. IM NOT LAWYER. GOOD LUCK!

Timeline

Your sister is on a tourist visa and will need to go home before it expires. I suspect the chances are good that she can apply for others in the future. But she cannot stay here beyond the visa she is traveling on. Your mom can petition for her to come her permanently but as others have said, it will take many years and there is little you can do about it. If she overstays her time here, it will just make matters more complicated.

As others have stated - your sister must go home before her allowed time on the I-94 expires. If she stays past her allowed time on the I-94, her visitor visa is automatically cancelled and she will have a very difficult time getting another visitor visa. (Her allowed time in the US is on the I-94 issued to her when she entered the US. Her allowed time in the US is not the expiration date on the visitor visa.)

Your sister is 27, so there is no way for her to immediately get her a green card. If your mother files as an LPR, it will take 7-9 years for her to get a green card and she must remain unmarried as long as your mother is an LPR. If your mother becomes a US citizen, it will take 7-8 years and your sister can get marry AFTER your mother becomes a US citizen. (If your sister gets marry before your mother becomes a US citizen, the petition is automatically revoked.)

Nothing your mother files will allow your sister to remain in the US legally. Your sister will need to return home and wait for many years.

thanks to everyone for your answers,

she will not stay here,she has a good job in her country but while she is here and if its better mom wants to apply gc here but as i understood it was not a good idea.my sister does not want to stay here therefore i was wondering if she has to stayin us during gc process.my mom wants her green card if one day my sister wants to come ligelly and work.she has 10 years visitor visa and she never over stayed in us during her visits.
