Just a quick enquiry guys, as I am a newbie. Got married to my sweetheart in Scotland (a USC) , last year, while i was a student. Still in the UK, and about to apply for my post study work visa, so we decided to go for the i-130, we have recieved approval

notice for this and we we are on the next stage and awaiting reciept for this stage. Question is about my eligibilty to apply from the UK, being a student (though switching to a 2 year work permit).

I am currently having visa issues, which i hope will soon be resolved or else, might go back to my country to continue the process. Second question is, if i go back to Nigeria, does this mean we have to start afresh?

Opinions will be appreciated.

Happy to help. I presumed you are between NOA1 and NOA2 in your visa journey. My advice is to email NVC the moment they receive your case from USCIS at the Approval of your petition. If you were able to resolve your UK visa before then there is no need cos as a Legal Resident of UK you are allowed to have your interview done but not when you are out of status. So if your visa issue is still the same by the time the NVC receives your file then email them immediately and let them know your intention of having your file transferred to Lagos. If you are able to do this early then it will save you time. It is no big deal to have your interview done in the UK as long as your visa is still valid, I went through this before even though not in the UK and I was fine. A member named "Omeka" is currently going through a similar situation and he also resides in the UK so you may want to contact him as well. Stay blessed and all will be well.

I agree with romnick...you need to sort your resident status out first before you can take the next step. I hope you get the extension because you will more likely get a better shot & avoid the confusion in Lagos... All the best
