Would like to ask about CSPA for my brothers but couldnt figure out when is their approval date. My aunt petitioned my father (F4) with Priority date of DEC 31 1984. Got a letter on May 1994 that my father's file has been transferred to NVC-- not sure if this is the approval date. FEB 2007 another letter was sent regarding the agent of choice-- is this the date when the visa became available? My brother's bday: June 3 1985. Thank you!

Which country are u from?When the petition reaches NVC, then your I-130 petition has been approved...Instead of waiting for the letter to arrive in mail, you can speed up the entire process by calling the NVC Customer service and provide the email address of the Petitioner and the Beneficiary.Agent of choice is not the date for visa availability, it merely states that u can appoint a person, usually the petitioner residing in the US( to make the mails arrive faster) to continue the process forward. As such your approval took 10 years, which inturn is beneficial to you as your brother is eligible for CSPA and can file for Visa as a derivative of this petition.

The NVC was created in April 1994, so all cases were transferred to the NVC at that time. A notice does not necessarily mean that was when the I-130 was approved.

Since you have not indicated which country your father is from - I am going to assume he is Filipino since his PD is 12/31/1994, and he didn't get his choice of agent until Feb. 2007. His PD became current on May 1, 2007.

To take advantage of CSPA, your brother must have "sought to acquire" US permanent residency within one year of your father's PD becoming current. That one year expired on May 1, 2008. Since it has been more than a year since your father's PD became current, your brother can no longer take advantage of CSPA. Sorry, but is too late for your brother to take advantage of CSPA under the petition for your father.
