We might need a bit more information, what do you think you would need a waiver for/be denied for?

Finally time for AOS.......

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

We might need a bit more information, what do you think you would need a waiver for/be denied for?

in 2009 my fiance went to tucson with his tourist visa and he went for vacation and stayed about 2 months because his car got messed and was waiting for the parts. and border portal stopped him and saw he didnt have permission to stay longer then 3 days( in tucson u need permission to stay longer then 3 days) so they took his visa and sent him back.

they gave him a punishment of a year and a half. after that time he was able to apply for a visa again. but they didnt give him no paper work or nothing. he wasnt working here in the united states he was just visiting (me, family)

but like I told you, if he isn't currently barred from entering the US, then that won't be grounds for a K-1 denial and no waiver is needed.

How would you know if he has a ban? Same thing happend to my finace but he was denied entry due to they suspected he worked in the U.S. and his tourist visa was taken away and POE. He was given a paper but no where does it say about a ban.

I honestly do not know what the penalties are if they suspect someone of working illegally. He was turned away and had his tourist visa revoked. I do not know beyond that the extent of his 'penalties'. Most people know if they are currently barred from entering the US because they were found guilty of criminal activities or overstayed. Overstaying more than 180 days is an automatic 3 year ban, and a year or more is an automatic 10 year ban. Some people have lifetime bans imposed, and are not even eligible to file a waiver if denied for a fiance(e) or spousal visa. If someone is denied a K-1 or spousal visa because they are currently barred from entering the US, they will be given a paper that tells if they are eligible to submit a waiver or not. If you committed no crimes or had no lengthy overstays, chances are you have no reason to worry about a ban. If any of that applies in your case, or you simply do not know if it does, then you should seek out a good immigration attorney for advice.
