ok so i was just reading this question about overstaying and i didnt want to bud in her question with mine.

So in 2009 my fiance went to tucson with his tourist visa and he went to vacation and stayed 4 about 2 months because his car got messed and was waiting for the parts. and border portal stopped him and saw he didnt have permission to take longer then 3 days so they took his visa and sent him back.

they gave him a punishment of a year and a half. after that time he was able to apply for a visa again. but they didnt give him no paper work or nothing.

Will this cause my fiancees k1 visa to get rejected?

but to prove he was working and was on vacation we got letters notarized by his boss at the time that he was working and was on vacation.

A ban is a ban is a ban. If he has been banned then they would not give him a visa of any kind. You say he has been allowed to apply for a visa again, so I assume they have given him one. If so, then no refusal on the K-1 for this reason

yeah his punishment was till march of 2010 after that they told him we was able to apply for a other visa. he applied for the tourist one again but they denied it cause he didnt meet the requirements. but he asked if he had anything in his record and they said no that it was due to lack of papers

this will not be an issue if time has been served
