I-129F Denied ----Refiling

I think your I-129f application is denied at the USCIS level. So you don't need to do anything, just refile another one with the appropriate documentation and fee. If it was approved and the embassy denied the visa, it will be totally different story. That was what to my fiancee. I did the whole thing again and got a lot more things to do with the paper work. Just make sure that you include the whole evidences.

Good luck

No need to say anything. Refile and attach proof of meeting this time. You should file correct information. Why on earth would you intentionally repeat an error?

Refile the petition

This would explain the "I somehow failed to prove that" question and would be a critical part of your plan to change. More important than the name spelling even.

I'm confused ! Question 11 on the I-129F asks if you have previously filed... so how do you "not say anything" (avoid answering this question) and yet avoid making errors?

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere, and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Thank you very much for your reply. So you think i shouldnt mention it at all even in question 11 on the I-129F when it asks if you have filed before?

No be completely honest when answering all the questions on the forms, if it has a section that specifically says describe why you were denied, or if they ask you why, I'm just saying you don't need to write out an essay on why you think you got denied the first time :P

lol, whatever you think the reason for a denial is doesn´t matter anyway coz it´s stated on the denial letter.

Read up on frontloading here and perhaps you can sail right through on this application, especially for items that are specifically requested for folks from that particular country. I'm sorry to hear of your delays. It is so frustrating.

How did you fail to prove you met? Pretty easy.. send in copy of your passport stamp and reeipt from airline book and photo copies of entering and leaving the country alone with photos together.

An airline receipt is useless as evidence of meeting. A boarding pass showing one boarding a flight into or out of a country is helpful, as are passport stamps. Photos together are a good idea but not sufficient evidence of meeting.

The OP received an RFE. That RFE spells out exactly what is needed as primary evidence of meeting. It should be studied carefully and then that's the kind of evidence to submit the second time around.

Facts are cheap...knowing how to use them is precious...
