Dear experienced VJ members,

I read on the forum that the petitioner must complete form I-134 and provide tax transcripts for past 3 years even if their income is not enough to sponsor the beneficiary. My question is: Since in my case I was filed as dependent on my parents income tax for past 3 years, do I include a copy of their tax transcript? or something else?

I will file independently for last year, so I can include that in addition to my parents tax returns.

My co-sponsor is my brother, and I have included his return transcripts as well. Would it be sufficient or confusing to the CO? Should I include a letter explaining why my parents tax return is in there? or Should I only include my own return for 2011 with I-134?

Yes, you need to fill out your own I-134, even if you made nothing, or not enough. You only need the most recent tax transcript. If that is your 2011, then just send a copy of your return including all schedules, attachments and W-2s. If you want to, you can include statement explaining that you have no other previous tax transcripts because you did make enough to be legally required to file and were claimed as dependent on your parents taxes. No need for your parents tax transcripts if they are not the ones co-sponsoring. Yes, it could just confuse them when looking through your paperwork.

Your co-sponsor needs to fill out his own separate I-134 and provide his most recent tax transcripts, letter from his employer, a few months worth of his most recent pay stubs, and proof that he is a USC or LPR.

The I-134 does not ask for 3 years of tax returns, it asks for the last years tax return. Some embassies may ask to see 3 years but that is embassy specific and not an I-134 requirement. Your timeline nor your profile state which country thus limits getting good responses. The co-sponsor has to complete an I-134 as well.

Wow, typed this too fast several typos, but the main one.... I meant to write a statement explaining that you did NOT make enough to be legally required by the IRS to file.

Yes, if his income is regularly deposited, then show the bank statements that prove he receives the income is deposited to his account weekly, bi-weekly, monthly, however he receives the direct deposits.

A copy of the co-sponsor's birth certificate or the bio page from his passport will work as proof of being a USC.
