In preparing for ROC, both my wife and I have compiled the following documentation:

Joint Tax Returns

Joint Checking & Savings Accounts

Joint Investment account

Joint car title

Various car insurance ID cards (joint)

My Life insurance policy designating my wife as the beneficiary

My credit card statements showing my wife as a second card holder

Our ID's showing our address together.

I noticed that in the instructions to I-751, it specifically asks for a copy of the joint lease or mortgage / title deed to our home. Because we purchased the property whilst I was outside of the US, in order to expedite the process, we agreed that my wife should go ahead with the purchase solely in her name (living in a community property state adding my name seemed superfluous). It was also beneficial in the case of our mortgage for my wife to sign this solely in her name using her own credit (having no SSN or US credit history of my own at the time we would have been unable to secure our current rate of interest). We have since looked at adding my name to the property title, however, due to the cost of remortgaging (and the fact that we'd be looking at a higher rate of interest) we decided against it.

We also do not have any joint utility bills. Again, these were set up at the time we purchased our home and for convenience taken out solely in my wife's name.

We do plan on including a note for USCIS with our package explaining the above (as I'm sure they will be curious about this) but wonder will all of the above be sufficient? We do not plan on including affidavits with our package.

I hope it is sufficient as that is what we will have. I have read and I believe that utility bills are not really needed as anybody can be added very easily. Tax returns and large investments are more important. Both being on the Deed to the house can be important but that is a financial decision that each and every person should be allowed to make based on their situation. I am wondering, did you have an interview for AOS? If you did then chances are good that the ROC will happen without an interview, but an interview may still be in your future. Given all the adjustments to living together and keeping the marriage together, if we make it to ROC THAT will be proof to me that the relationship is bonafide and strong and should survive. Let's just say it has been a rough first year and I pity any USCIS worker that tries to tell me our marriage is not legit.

Your evidence is similar to what we provided. We too bought a house in my name only, because it was quicker to get a mortgage that way. The utilities transferred to the new address and remained in my name. There was no RFE or interview. The last interview attended was in London. Even if you didn't interview for AOS, you probably won't interview for ROC. Interviewing is very rare for this step.

About the house thing. We are in a community property state too and I have inquired how to get his name on the deed. Seems like a waste of time and money. I paid off the 30 year mortgage in about 18 months and as full owner I still can't get a straight answer. I think I can execute a deed of trust transferring ownership from me, to him and me together, but haven't bothered with exactly how to do that legally. Lawyers won't even reply to my emails asking about it. Guess they think it's not necessary in TX. He'll interview for citizenship an a month or so and I don't anticipate a problem proving we have been married these 3+ years despite not owning a house jointly.

We had less than this as we live with my father so no lease or even bills in both our names. We have car insurance, joint taxes and a joint bank account, knowing we didn't have a lot we included 6 affidavits. We were just approved last week with no interview or RFE. I also included in the cover page as to why we didn't have bills together or a lease/mortgage.

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!
