Timeline

I got a RFE today for them loosing my packet and not having any medical records of me.... FUN FUN lol

Now my question is that i do have copies of my full medical conducted in australia about 6 months ago, can i just send in those copies or do i need to have a brand new exam.

Anyone who has been through this can help Please........

It is less than 1 year so it is still good, send it back plus the RFE letter. Good luck.

Your exam was less than a year ago, and you are lucky enough to have copies from it. Send in your copies as proof of your medical.

I don't think that's right. Your lost medical was in a sealed packet so you don't tamper with it. A I-693 you do in-country is also in a sealed packet so it is not tampered with/changed. I don't think you can send in a photocopy that is in your possession, because that could be forged/altered. I am sure yours isn't forged, but I don't think a photocopy will suffice for the RFE. If it was, what would be the point of the sealed packets anyway? Why wouldn't they just give copies to the people and let them turn them in themselves instead of turning it over at POE? You can get a new medical for around $200 or less.

Please let other members weight in before sending in the photocopy. You only get one chance to get the RFE right. If you send in something that is inadequate, your application will be denied.

People have asked for copies of their medical from the sealed envelope at their POE and have received them. I am not sure the medical records being sealed in an envelope is all that sacred past the interview stage, but I understand what you are saying.

OP> You could make an InfoPass appointment, take the copies you have and ask them about sending those to satisfy the RFE, since they are the ones that lost your medical somehow. You could also ask them to track down your A file, which contains your medical.

You could skip all that and just go ahead and send in the copies you have, or you could play it completely safe and pay again and get another medical you did not need, and should not have had to get, so you can send them an I-693.

You can do a search here on VJ for lost medicals. There are plenty of posts about it.

How you want to deal with the RFE is up to you.

Well sorry, when you deal with USCIS, something missing is your fault automatically, not theirs, USCIS is always right. That's why they ask for RFE, otherwise they will send a sorry letter for mishandling your application, and ask you to please send them another copy.

You should be totally fine sending a copy of your medical and I would include a cover sheet that says "Please find attached, a copy of report from the medical exam conducted for my K1 visa in XX Australia. The original medical should have been in my "A file" handed over at XXX (name of POE) when I entered the US on my K1 visa on XXX".

You could also try making an INFOPASS and asking THEM to check your A file. You could try involving your congressperson/senator and asking them to tell USCIS to check your A file. Or if you're really worried just do a new medical. You should be fine sending a copy of your K1 medical but sometimes USCIS doesn't know it's ####### from it's elbow.

When i was AOSing in 2010 they were routinely losing K1 medicals so several people had sent in copies of their K1 medical successfully. That is why I have a copy of my medical... because it was suggested back when it was happening to almost everyone that you do that. They DO have your medical in your A file but they just can't see it... at my POE the officer didn't see my medical and I had to point it out.

Its not that i am trying to be rude or saying your wrong but i am just trying to play it safe thats all.
