I am wanting to know at what point in the process will I send the affidavit of support form in. I just received NOA1 this week. I am self employed and my financials will be somewhat more time consuming and complex than just turning in tax forms. Hoping I have some time here. Thanks

You will need to send the I-134 affidavit of support to your fiancee because she/he will need it for the interview. It is advised to start gather and send it as soon after you will get NOA2, which should be in 3-5 months. If the supported documents are complex to gather, you can start looking at which documents you can get, how to get them and how long it takes now…

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Affidavit of support comes with the Packet 3 stage, the non-US fiance(e) will need to submit it to their consulate as part of the final questions.

This was the biggest hurdle for me during my K-1 process, my advice is the same as the other replies, start researching what you will need now.. and act upon them around the time you receive your NOA2 from the USCIS...

I didn't do this and it added a good month to the process *sigh*, as my US fiancee was unemployed at the time so we needed co-sponsors, it was tedious, but it was okay in the end.

Hi, im new to this, but my fiance has received his packet 3..i havent gotten mine as yet..but for the affidavit of support form I-864, does it need to have a barcode at the bottom of the first page?

Just to clarify, you (the US-Citizen) will NOT receive the packet 3, the packet 3 is for the non-US fiance(e) only, you will need to send them some documents (affidavit of support etc.) but yeah the non-US fiance(e) is responsible for filing the Packet3 document package at the US consulate in their country.

And regarding the I-864, I'm not sure but mine definitely did (I just rechecked that).

That being said, for me anyways (it might differ from country to country) but the I-864 Affidavit was only required as part of the AOS (Green Card) application. For K-1 VISA, the affidavit of support was via form I-134... you might want to double check that. The main difference is for I-134 didn't want to know about IRS tax information (for K-1 VISA) but form I-864 does require submission of IRS tax documents.

So yeah I think you might be confused as to which Affidavit of Support you need to file..

You might be surprised. If your line 22 total income on your 1040 was sufficient then they'll usually consider your affidavit of support to be sufficient. If you clear the minimum by a comfortable margin then they're even more likely to consider it sufficient. If you can submit three years of transcripts showing sufficient income each year then you probably have it clinched. You might not need to submit anything else.

On the other hand, if your line 22 total income is below the minimum then you'd need a pile of evidence to prove your income THIS year will be sufficient.

At most US consulates, packet 3 is the invitation to submit a visa application. Packet 4 is the visa interview appointment. Most consulates require the affidavit of support to be submitted at the time of the interview.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Thanks for the advice. Well I'm working on tax forms "I'm behind" unfortunately. My income might be below the required by a 1000 or 2000. Business really struggled the past three years but I have had steady improvement each year. One question is "how do assets play a role" I own a home worth 110,000. No morgage. I own half of another home my equity there being 60,000. a morgage still exist on that home but it is paid by the ex until we eventually sell the home. That was decided as we have a child. He's 14 now so that home will be sold soon. Anyway, how can I use this to offset my lower income?? Thanks to you for all your help

Thank you to everyone for the information. I'm on it ! :) I just kinda needed some steering here because mine is asset heavy and income low. thanks for all the advice.

As a self-employed person your "current income" will be the number on line 22 of your 2011 tax return. So, make sure that number qualifies you as the sponsor. Unless you need to use liquid assets to qualify, it really isn't more complex than that.

Plan on needing that tax return copy in hand around June.

GrayL, thank you so much!! You really saved me some time! I do recall my fiance telling me about the I-134 earlier tonight as we were going through the contents of the package..I was kind of unsure about it though. Reason being, that we have to use a joint sponsor because i don't make enough :( I saw in another post that you and your fiance also had to use a sponsor. I know this is silly, but was form I-134 the only affidavit of support form you used? It just doesn't seem like enough to me :wacko:

One I-134 for you and one for the cosponsor. Then, after marriage, one I-864 from you and one from the "joint sponsor".

Regardless of your income, you will need to complete a form I-134, then the co-sponsor will also fill in an I-134, plus all the extra supporting documentation. I can only really specify what I needed, different US countries around the world may need more. The good news is it's VERY black and white, in my experience it wasn't an issue at all that my now wife (the US Citizen) was unemployed because our co-sponsor met the guidelines. Basically they MUST make 125% of poverty, which depends on the household size, but if they make it on income alone, it's a much easier process. Feel free to pm me if you like we can discuss this further, I'm MORE than happy to help because I needed so much help from people on VJ for this. So yes the I-134 is the only Affidavit of Support you will need, but remember to include the necessary documentation to go along with it.

The i864 is a binding document, you will be responsible for support then. Probably too late in this discussion, but I would gather any and all information as I go then it is not a problem to add to it or have it during the upcoming processes. That is from initial K1 to AOS and your interview..
