Hello,

I got here in US December 03 last year and the immigration officer told me that we should get married before February 29. My fiance and i just got married this Valentines Day , we both don't know how are we going to start to file my AOS and what last name should i write in the I-485 form, is it his family name or mine. And i don't know what to put in the Current USCIS Status in the form. We want to file my AOS as soon as possible because we are busy with our Church wedding next month and to prepare for nclex exam. Please help us. Thank you!!!

Now that you are married --you have to put your husbands last name as your last name . You can keep your maiden name as your middle name . My wife dropped her previous middle name (mothers name ) and kept her previous last name (fathers name ) as her middle name , and added my last name as her last name .

You do not HAVE to change her name. If she WANTS to she can.

There is no such requirement for a woman to take her husband's name. She can choose to take his last name. She can choose to keep her maiden name. She can choose to hyphenate her maiden name and her husband's name. There is no HAVE to take the name of her husband.

To the OP> Use the name you are planning on legally going by. If you are keeping your maiden name, then use it on the forms. If you are taking your husband's name, then use that on the forms. Your EAD/AP and green cards will come in the name you put on the forms, so be sure and put the one you are planning on going by from now on.
