Interview in 5 days,... Possible red flags

Have posted here a few times, thanks so much for the information members of this board have provided.

My spouses interview is in 5 days, just I think like everyone a little worried. We (well more me) have some red flags that I'm just trying to look at and say, how will they be seen?

I'm in the US Military and was living in Italy with my ex-wife (wife at the time (USC also)). It was obvious that our relationship was over then, however being in Italy made it very difficult for us to file for divorce. As a result we basically lived two different lives, while still living together (very difficult situation - Jerry Springer like) but from about December 09 in Italy it is what we did.

In June 2010 we left Italy, she went to Florida and I spent 5 days in the US and then left for South Korea. While in Korea I met someone special whom I developed a relationship with and fell in love, we lived together and made our life together. In December 2010 I came back to the US for 30 days and filed for divorce, I left the US again in January 2011 to go back to South Korea. Between January and June I continued to be involved with (now my wife), however very little could be done on my part concerning the divorce because of my being outside the US (Solders and Sailors Act - issues with my ex pressing forward with the divorce w/o my being in the US) while the previous stated Act is designed to assist active duty military from civil action while serving overseas in this case it harmed my progress of actually getting a divorce.

In June 2011 I then returned to the US, had to basically refile the divorce paperwork and once again wait. The divorce was finally completed and final in late September, I waited two months then went back to South Korea in November and got married. I did my homework and learned the state of Florida has no waiting period to remarry like some states do. I did consult an attorney whom suggested I do wait a little, 60 days or more before going back to Korea to marry.

As my spouses interview date approaches the more this is worrying me as a possible red flag.

Important things to note:

-This my first attempt sponsor a visa to the US of any nature for anyone.

-I have no other red flags that I'm aware of.

-My spouse has no red flags.

In our petition application I have included:

- My military orders to/from South Korea.

- 480 pages of MSN chat conversations between my wife and I.

- Pictures dating from July 10 to June 11 of wife and I.

- Pictures from the two trips I have taken back to Korea since leaving in July 11.

- 20 pages of phone records.

- She has a debt card to my bank account (can't add her to the bank, USAA will not allow me to since she is not in the US, no SSN).

- 3 affidavits from 3 people who know us both and know of our relationship (to include a person who lived in the same apartment complex in Korea with us).

- 2011 taxes (filed married w/ wife).

- Proof I have added my wife to my military health insurance.

- Proof I added my wife to my life insurance (400K).

I hope I have provided enough information for an educated guess on this situation and "how big of a red flag it may/could be"? Any thoughts would be great?

Thanks

You should not worry. After all its not going to help your interview in 4 days. Do not go in and lie though. Be truthful and honest. They are usually understanding with military laws like Servicemember's Civil relief Act.

Oh ya that is in it. I got an RFE for that one, lol! I sent just the final judgment, however the RFE requested the full document. Sent and then sent a certified copy of it to my spouse as well for the interview (the copy the USCIS/embassy has is the requested faxed copy that I sent 2 months ago).

If your spouse is prepared to tell the story as you wrote it in your opening post, I would expect no problems.

Facts are cheap...knowing how to use them is precious...

Just make sure your wife knows the whole story, details and all. They may try asking her questions like "Did you know your husband was married to someone else when you met?" etc.

Nothing you describes in any way presents an issue in getting the visa, but it may make the consular officer press harder in the interview to make sure everything is on the up-and-up.

Sweet... She knew the truth from the moment we first met. I was very forward, honest and open w/ her during this. Yes, it did make things difficult at times! However she had faith in me and I think/hope my openness about it from the start is what helped give her a little more faith then what I think most would have had.
