Hello everobody!

Me and my husband got married on K1 VISA last year and now working on the AOS. I got the first NOA on January, 23rd and got my biometrics done last week.

Unfortunately USCIS sent me a RFIE (Request for Initial Evidence) on February, 6th. It says that there is something wrong with Form-864 but it doesn't specify what exactly. We called the national service center and they also couldn't gave us any particular information. I'm guessing that the reason might be that my husband didn't fill the iformation about his 2011 tax returns but he didn't have it done in January when we sent the package. He just redid it. If there is something wrong with this form again are they going to send another RFIE or it could cost denial?

I'm really worried about this and I would appreciate any help!

Wait for the RFE, that will tell you what's wrong (he probably didn't sign it, or didn't include some pages or something). 2011 taxes weren't required so it's unlikely to be that.

If you don't reply to the RFE correctly you will be denied. They don't RFE twice for the same thing.

They told you something is wrong with the I-864 in your email? Normally they don't do that. They just tell you that they are requesting initial evidence or further evidence. Can you clarify if you received the physical RFE. Then again they would be more specific than just saying something is wrong with your I-864. Which one is it? It's unusual for them to to state in the email because it's a general notification and it's too vague to be an actual RFE. Are you assuming the possible reason for the RFE?

Yes, it is physical RFE. It says exactly:

Submit a completed and signed Form I-864 Affidavit of Support for the petitione/sponsor listed on Form I-129f. Also provide copies of the petitioner's most recent Federal Income tax returns.

We submitted copies from 08, 09 and 2010.

So you sent the I-864? The actual document called I-864? And you included tax returns ? Or tax transcripts?

It is Tax Return Transcript for last 3 years.

You need to answer my questions exactly. ONE transcript that included 3 years? Or One transcript PER year? And you did include the I-864 itself? Do you have a copy of it? Was it filled in correctly? Did you mail ALL the pages?

To be honest, I'm not sure if I sent all the pages. I thought I did but when I got the RFEI I looked on the copy I made and it misses the last page. Now I'm not sure if I didn't print it at all or just missed to copy it.

Do you know what is the procedure for getting an infopoinment at the local USCIS office and would they be able to give me some information?

Misses the last page of what? The I-864? That would make the I-864 worthless. The last page contains the sponsor's signature.

Don't overthink this. Prepare a new I-864. Make absolutely certain it's correct and complete. If you sent the original transcripts with the first I-864 then get new transcripts. Otherwise, make copies of the transcripts you've already got. Send the new I-864 and transcripts in response to the RFE.

I just notticed that on Part 3,question 10 we putted 0 and it would make more sense for me right now the number to be 1 bc my husband actually is sponsoring 1 person, in this case me. It's the same on Part 5, question 21.

Could this be the reason for the RFI?

I do not know the reason for your RFE, just that you got one and should send them back what they want.

However, yes, you filled out the form incorrectly. #10 should have been 1, which is you, the immigrant, and #21 a. should have a 1 as well. See the example form: http://www.visajourney.com/examples/INS-Form-I-864.pdf
