From what people are telling me, K1 is the way to go. Yet I've also read the guide lines and it says the K3 might be faster. But in those same guide lines it says 2 months longer to get green card status on a K3. So I guess what I'm confused about, will a K3 actually allow us to be together in the US sooner than a K1? But then take a little longer to get green card status?

Also, she wants a wedding in her home country, Uzbekistan. I think that's fine and statistically marrying in their native country increases the chance of success by over 20%, so I'm all for that. However, hypothetically, what would happen if we were part way through the K3 process and she was to become pregnant? I assume if she didn't give birth until after she was here then it's a non-issue, but if she gave birth a few months before, would that slow things down?

While the K3 officially remains on the books, it's practically nonexistent in practice.

Here is a typical timeline for a K3:

  • I-130 filed and accepted
  • I-129F filed
  • I-130 pulled from its place in the queue and placed with the I-129F that was just submitted
  • Adjudication decision on both petitions is made at the same time
  • If both are approved, they are sent to the NVC
  • Usually the NVC receives both petitions at the same time or the I-130 first which results in the I-129F being administratively closed leaving only the I-130 active

If you get married abroad, file the I-130 as a standalone and pursue the CR-1 process.

If your spouse were to become pregnant and give birth prior to an interview, the child would require a Consular Report of Birth Abroad (CRBA) before it could come to the US.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Please edit your timeline to show BENEFICIARYS COUNTRY. it is the 6th line down in EDIT/ADD timeline

That way your question will flow to that countrys portal and people with knowledge of that country will answer best

if I plan to marry her on July 1st (still waiting for my US citizenship final approval), how long would it take approx to have her here, assuming we marry in her country?

I do have her country listed in my timeline, but it's not showing, I suspect because I've not selected a visa. I've not selected one because until my US citizenship is finalized, there's little point in starting visa paperwork for her.

it is BENEFICIARYS COUNTRY that needs to be filled in. It is the 6th line down.

Good Luck in either visa you choose. It is up to you. Study the benefits of both and the pitfalls of both

K3 is like a nonimmigrant visa. She comes here and cannot work for 3 months. You have to file more papers and more money

CR1-she can work within 2-4 weeks of getting here. She has an Immigrant visa good for 2 years before more money and papers is needed.

If you study timelines K3 are not faster lately. They used to be years ago when the CR1's were taking over 2 years to process. Now most CR1 take 10-12 months

Yeah I did, I just looked again and it clearly shows Uzbekistan.

Should I start a timeline for my own Citizenship here in the US? I've had my GC 8 or 9 years now and filed for my Cit last Aug but missed the finger print date and am in the process of getting it rescheduled.

I suggest you only focus on the timeline for yer lass. if you put yer timeline in now, then later, when you wish to put in yer lass's timeline info - you can't, without starting a new profile. one profile - one timeline.

Estimate 7-10 months from the time the petition is filed to the time a visa interview is scheduled.

I do have her country listed in my timeline, but it's not showing, I suspect because I've not selected a visa. I've not selected one because until my US citizenship is finalized, there's little point in starting visa paperwork for her.

You can always select a visa path you will take, even if you haven't filed yet and update it as appropriate. When you update your timeline, you must scroll to the bottom of the page and push the "submit changes" button or it will not update. I agree with Darnell, only update the timeline to reflect the progress of your significant other.

To make the country flag appear next to your posts, do the following: on the upper right corner of the screen by your username, click "settings" then locate and click "profile" then scroll down until you see the field "Country of non-US Family Member." It is that filed where you will be able to select the country, click the "save changes" button so your updates will appear.
