I havw seen the same numbers elsewhere so be prepared for USCIS to announce soon. Looks like about an extract 400 a year for 100% for 2

On Jan. 26, the Department of Health and Human Services (HHS) published the new federal poverty levels (FPLs) for 2012. The annual poverty rate (100% FPL) is set at $11,170 annually for an individual ($15,130 for a couple) in the 48 contiguous states and District of Columbia; slightly higher in Alaska ($13,970 for individual, $18,920 for couple) and Hawaii ($12,860 for individual, $17,140 for couple).

This will not be over quickly. You will not enjoy this.

we think I-864 is unconstitutional, it discriminates between rich and poor.

i am a South African citizen, My lawful wife (married 2009 in USA)and our son (born 2010) are American citizens born in USA.

We currently live in USA Seattle , we have filed with uscis but they have not accepted the I-485 because my wife's income is less than 125% of poverty guide line on the required I-864.

We don't have any family or friends who qualify or who are willing to co sign (be a sponsor)the I-864

(we also feel that the requirements of I-864 are a violation of my wife's equality rights as a US citizen because it discriminates between rich and poor.

Also asking some one to sign SURETY is contradictory to our faith as Christians: Prov 6:1, *11:15, 17:18 ... )

Question, what can we do now and who do we talk to.

sure and if there is no more minimum income requirement everybody can immigrate. even if they can´t afford living in the US! but hey, that´s why there are tax payers, right!? so they can take over if you can´t afford rent, food, health insurance,... anymore. I`m sorry, but the poverty guildeline (just like the 125% of it) is everything but high! that´s what we pay rent per year!!! try to immigrate to austria for example. the poverty guideline for 2 ppl is at least 21500€=27950$! it´s kinda based on rent too, if you have to pay more rent the poverty guideline for immigration rises!!! do you think it would be fair to have the america, austrian, (or wherever you are from) taxpayer pay your bills???? the poverty guideline for immigration has the purpose tho protect the country and it´s citizens! the law and contitution ´don´t have to be fair for the individual, they can´t be fair to the individual!!! because what´s fair to me is unfair to you, right !?!!! the I864 is just one example of many!

The poverty guidelines are low. She needs to get another job in order to afford the cost of living in order to make sure you do not become a burden on society.

The guidelines protect the USA and taxpayers from allowing people to migrate here and not be productive members of society.

Move to South Africa. Nothing prevents you from doing that.

In what possible way is the I-864 unconstitutional? discrimination against the poor is not prohibited.

To everyone who replied to cre8hive - did you read their post? Am i wrong when i say that he is currently in the USA - his wife is a US born citizen filing for AOS I485)?

SO - if that is the case - why are you telling them to move to SA?

If he is a legal immigrant - resident or non-resident - then he and his wife have every right to ask the question about the poverty guidelines and the I864 requirements.

Isnt that the right of an American Citizen? Freedom?

Or am i wrong?

For the record and full disclosure - im a UK born LPR living in the US - waiting for my wife's petition to be approved.

I likely wont have any issues with the I864 requirements - but reading the posts here struck me as very anti-VJ compared to all the other posts i have seen here. So i ask - what gives?

You said you currently both of you live in Seattle and that her income is too low. If you are here legally, and she applied an IR-1 for you, then you probably should have applied for a work permit at the same time which would have allowed you to work while waiting for the rest of the process. If indeed that was done, get a job so both your incomes can be used.

The only thing I agree with you is that the poverty threshold is a miningless tool. Different levels of income can support or not support a family. It all depends on how people plan to live within their means. Here in Texas, I have seen people support families with the mimimum wage. I have also seen people who make $150,000 a year struggle to support their families.

Otherewise there is nothing unconstitutional about a country wanting to make immigrants take care of their own and not become a public charge. It's their prerogative, even though the tool used is lopsided.

However, If someone earns what the same US government has set as a mimimum wage, therefore a living wage should be enough for immigration. What is discriminatory is that the US sets the minimum wage to be what they consider to be a living wage to its own citizens, yet the same standard is not applied to other would-be citizens. Why is the minimum wage good enough for some but not good enough for others?

It applies to would be legal residents.

Sure they can question it. If they want to do so from the US and not SA then they have to meet the guidelines. He is not yet a legal immigrant, he is applying to be a legal immigrant.
