I-130 Filed for Illegal Husband

Hi everyone

My husband and I filed and I-130 in Aug of 2011 and we are still waiting to get the approval letter back. They say the processing time is 5 Months and we are reaching 6 now. What would the reason for the delay be? She we be worrying that something is wrong? I may just be getting antsy but i just want to get this all over with. Any information will help. Thank You

6/6/2014 - Meeting with Lawyer to start process
7/15/2014 - ROC mailed
7/24/2014 - Received at USCIS
8/11/2014 - Biometric appointment notice received

Check your status on the uscis website. If it went to California, it probably hasn't even been looked at yet. We sent in ours on September 17. They received it September 19 and it hasn't been touched since.

I'm sure your petition is sitting on a desk somewhere waiting to be looked at. Don't stress too much yet. We should hear something soon.

That 5 months processing time is stated as a "goal" it is not a definite.

You refer to your husband as "Illegal Husband" how did he enter the country?

If she stated that her husband was Illegal. It most obvious that he entered the states Illegally.

When i filed my petition, it took about 4 months. But i have friends that have been waiting for several months. On the other forums that i'm on, i believe its taking longer because august-december waivers have been shipped to numerous locations outside of Juarez. Including to the California office. I think it is causing a backup of approving petitions as well. I hope this helps. If you'd like to message me you as more then welcome.

May 2005- Met my husband

June 2005- Became a couple

September 2006- 1st son born

July 2007- 2nd son born

June 2010- Married

September 2010-Hired our Lawyer

October 15th 2010- Petition Sent in

December 2010- 1st daughter born

February 7th 2011- Petition Approved

August 3rd 2011- recieved our appointment

September 1st 2011- 1st appointment- denied, but approved for a waiver

November 14th 2011- 2nd appointment, turned in waiver

_ _ _ _ _ - Visa Approved (still waiting as of February 18th 2012)

My husband did enter illegaly. He has been here for about 11 years. We do have a lawyer filling out all the paperwork and i know this is a long process but i am getting antsy. I just want the approval from the I-130 already. I have finally seen someone whos NOA1 date was Aug 8th so it looks like they are getting closer.

I'm not the original poster, but I am quite curious -- is this even possible? Can you enter the United States illegally, stay here (presumably with no legal status) for eleven years, and then submit an I-130 in an attempt to gain status? Wouldn't you at that point simply be deported and then subject to the 10-year ban?

Then it is not possible for your husband to AOS (Adjustment of Status) based on the I-130 petition your attorney filed. Your husband will have to exit the country and travel back to Mexico to be interview at the consulate there. The problem with that is, your husband has been in the US illegally for 11 years, also known as -- EWI (Entered Without Inspection). Unfortunately, your husband is subject to a 10-bar -- that bar is triggered the moment his crosses the border back into Mexico.

Be prepared with a waiver at the time of interview so as to save time with a possible approval.

Your attorney should've told you that it is not possible to AOS while in the US.

Not necessarily, there are thousands that enter the US legally, then become out-of-status on their visas by overstaying beyond the date on the I-94. So one can enter legally and later become illegal.

THe OP is not doing AOS, so there is no point in scolding her for something she isn't doing. She seems fully aware of the ban, waiver, trip home, etc. That is what she is doing.
