Wife Filed tax 2011 as Single, is there impact on Visa issuance

I have more than 3 members in HAITI that filed single and got issued the visa without any question related to it by CO. So i definitely will not amend the tax until i arrive in the US

So what should one do if your country is not part of the Hague convention agreement? Pakistan is not part of it?

I have a photocopy of my wifes passport - got it stamped/signed by a government official - the issuing authority does NOT provide certified copies...so this was the best i could do...

I think that if you can't get Apostille Notorized (those countries part of Hague Convention)

then i think if you can get Notorized from US Embassy in Pakistan or

If you are the USC and have the real passport in hand, get it Notorized in US.

also they didn't need the real person there (your wife) present to get it notarized?

i guess for me i'll do Apostille notarized, since it is not with me in US

No, I went to a Notary public near my work. I showed them the color photo and the passport. They notarized it right there on the spot. When I initially asked them to do it, they had puzzled looks on their face like, "why, you want this notarized?" I told them I needed it for tax purposes and of course, like many others who don't know what they are doing, they said, "Oh you don't need to notarize it." I said, yeah I do and explained to them the rule. They said ok, and notarized the copy.

Keep in mind that the regular notarized passport copy will not be enough, you will need apostille.

Ok so the beneficiary went to get her passport Apostille notorized but they said they won't do it on a copy. They said the will only do on real passport Which does not help at all.

So what is my option now?

1) Beneficiary sends me her passport and i get it notorized at a bank in US?

Downside is that here is a chance of passport getting lost in mails...that would be scary.

How about sending the ID and the Birth Certificate? You can use two forms of ID if you do not have a passport. It will be much easier to get an ID than the Passport. -Check W-7 question 6d or read the w-7 instructions.

2) USCIS Documentation = Beneficiary's Photo and a copy of I-130 app which was submitted to USCIS?

You can submit the national identification card, the foreigner's voter registration card, birth certificate, school records -if they are from a foreign country. The Photo ID must be notarized. Remember to include at least 2 of these to prove Foreign Status and Identity.

Copies Only.

But if you go to your Local IRS office you take the original documents (ID) for them to see it and that's it. You don't need to get them notarized.

i FILED MY 2011 taxes at the IRS becase I didnt want any issues being that i got married in may 2011, they told me to file form 1040 "Married filing separate" . if you are married, you must show it on your taxes, even if she dont have a SSN or TIN NUMBER!!

Because my wife has never been to the U.S SHE IS CONSIDERED nonresident alien spouse. The IRS only used my W-2 and in the area were the spouse name goes on the 1040 - the agent put "NRA"!

The IRS did did my taxes in there office, so yes they accepted it on February 1, 2012. They told me my wife don't need a ITIN from the IRS unless she has income i need to claim on my taxes.

Again, this was done at the IRS OFFICE here in Texas!

Also, I gave a IRS Stamped copy to my wife to bring to her interview, this will show that i filed as married!

NO!!

There was no need as i said. The IRS Agent prepared my taxes in the Austin, Texas office, made me a copy and stamp dated the IRS RED STAMP on each and gave me a copy for my records!!
