Hi all

I just learned you can request to expedite the i130?

We just barely submitted ours, can I request it be expedited still or would we have to have done that when we sent it in?

I know we would have to have a compelling reason and supporting documents for them to consider this. I'm just wondering if it's still possible?

Any info is appreciated :)

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Does anyone have an example of humanitarian situation would be?

Also, if expedite is denied it doesn't mess up the rest of the process?

Humanitarian situations would be if your partner is a refugee, victim of a crime, severe poverty etc

Do they do anything at all if the applicant is a veteran?

Nope only active duty.
